VISTO the Organic Law of the Foreign Service of the Nation No. 20.957 and its Regulations approved by Decree No. 1973 of 20 October 1986, the provisions contained in Decree No. 2048 of 22 December 1987, their amendments and supplements, and
CONSIDERING:
That under the provisions of Decree No. 2048/87 the Ministry of Foreign Affairs And CULTO raised a proposal whose main objective was to replace several articles of the aforementioned regulation of the Organic Law of the Foreign Service of the Nation, which, after being properly evaluated, is to be receptive in the text that is propitiated.
It is therefore essential to specify the scope of the rules governing the categories and performance of the functions of the staff of the Foreign Service of the Nation in order to bring them into conformity with the spirit of the Organic Law of the Foreign Service of the Nation and its regulatory decree.
That the categories of staff of the Foreign Service of the Nation can only be applied to officials with diplomatic status, without prejudice to the provisions regarding the assignment of protocol rank to other officials.
That the diplomatic status referred to in articles 2 (a) and (b) and 19 of the aforementioned Organic Law of the Foreign Service of the Nation No. 20,957 has direct and exclusive relation to the functions, duties, rights and prohibitions of diplómatic officials, without prejudice to the specific provisions of articles 9, 10 and 97 of the said Law and its regulations.
Article 86, paragraph 2, of the National Constitution empowers the executive branch for the execution of this measure.
Therefore,
THE PRESIDENT OF THE ARGENTINA NATION
RIGHT:
Article 1 - Replace in article 3 of the Regulation of the Organic Law of the Foreign Service, adopted by Decree No. 1973/86, the expression: "It does not require regulation" by the following text: "The categories established comprise only officials defined in section 2 (a), (b) and (e) of the Law, without prejudice to the provisions concerning the allocation of protocol rank to other officials".
Art. 2o - Replace in article 19 of the Regulations of the Organic Law of the Foreign Service of the Nation, adopted by Decree No. 1973/86, the expression: "It does not require regulation" by the following text: "The provisions concerning the diplomatic state apply only to officials defined in article 2 (a), (b) and (e) of the law, without prejudice to the provisions of articles 9, 10 and 97 of this regulation".
