Please note that the amounts of the benefits provided for in article 1 of Act No. 18,017, which are fixed, shall be of a minimum common to all public and private activities and other beneficiaries covered by the family assignments scheme.

VISTO the power vested in the NATIONAL EXECUTIVE PODER by article 26 of Act No. 18.017 (T. 1974) and

CONSIDERING:

That under the above-mentioned rule the Executive Power is empowered to modify the amount of family allowances.

That by Decree No. 101 of 16 January 1985 (Article 3) (c)) was delegated to the Ministry of Labour and Social Security and ECONOMY to update the amounts of benefits.

That by the Nros Decrees. 8,620 dated 31 December 1968 and 2,020 dated 30 April 1969 and by Resolution S.E.S.S. No. 366 dated 10 June 1974, the benefits of Act No. 18,017 were extended to the staff of the National Government and the Municipality of the City of Buenos Aires and to the beneficiaries of the national insurance scheme.

It is necessary to reconcile the need to set the value of family allowances in an amount that meets the goal of comprehensive family protection with the non-homogeneous economic-financial possibilities of the agencies and entities required to pay.

That the permanent existence of financial surpluses contradicts the purposes that led to the creation of Family Assignment and Grants Funds.

That once the minimum amounts common to all recipients of the family allowance scheme are secured, absolute preference must be given to the application of the Funds ' resources, within each of them, to the destination for which they were created and those collected.

That the measure fits into the powers granted to the NATIONAL EXECUTIVE POWER by article 86, paragraph 1 of the NATIONAL CONSTITUTION.

Therefore,

THE PRESIDENT OF THE ARGENTINA NATION

RIGHT:

Article 1.- The amounts of the benefits provided for in article 1 of Act No. 18,017, which are established in the exercise of the authority granted by article 26 of the Act and article 3 (c) of Decree No. 101 of 16 January 1985, shall be of a minimum common to all public and private activities and other beneficiaries covered by the family allowance scheme.

Art. 2°- MINISTERY OF WORK AND SECURITY on the proposal of the SECRETARY-GENERAL SOCIAL, may set for the scope of each Fund of SUBSIDIES or FAMILY ASIGNATIONS, higher values for all or some of the benefits, in accordance with the financial availability of each of these Funds.
