SECURITY FORCES Decree 1310/88 Amendment of the Regulations on Qualifications, Ascense and Removals of the Federal Prison Service staff.

VISTO the modifications proposed by the NATIONAL DIRECTION OF THE FEDERAL PENITENCIARY SERVICE to the Regulations of Qualifications, Ascense and Removals of Your Staff, and

CONSIDERING:

That Decree No. 54/76 approved the Regulations on Qualifications, Ascense and Removals of the FEDERAL PENITENCIARY SERVICE Staff.

That it established the form of constitution of the Qualification Boards that deal with the promotions of the staff.

In this regard, it is necessary to incorporate the Directors General as members of the Higher Qualifications Board.

With regard to the Staff Qualifications Board, it is appropriate to authorize the said NATIONAL DIRECTION to integrate them with staff of immediate rank below the prescribed regulations and to increase the number of staff members when it is essential for their effective functioning.

It is attentive that the Higher Board of Qualifications could not be constituted, in the month in which it is regulated, in order to dictate with respect to the higher staff that must be withdrawn on an annual basis, it is appropriate to authorize the NATIONAL DIRECTION of the FEDERAL PENITENCIARY SERVICE for this one time to make the corresponding call in the month of September of the current year.

That intervention has been given to the Directorate of Audit of the FEDERAL PENITENCIARY SERVICE, which has no objection to formulate, as well as to the Permanent Legal Advisory Service of the SECRETARY of JUSTICE under the Ministry of EDUCATION and Justice.

That the present measure fits within the powers granted to the NATIONAL EXECUTIVE POWER by article 86, paragraph 1, of the NATIONAL CONSTITUTION.

Therefore,

THE PRESIDENT OF THE ARGENTINA NATION

RIGHT:

Article 1 - Replace article 25 of the Staff Qualifications, Ascense and Removal Regulations of the FEDERAL PENITENCIARY SERVICE, approved by Decree No. 54 of 10 January 1976 with the following:

Article 25: The Higher Board of Qualifications referred to in article 76 (a) of Act No. 20.416 shall be chaired by the National Deputy Director and composed of the Directors Generals and Inspectors Generals in operation, acting as Secretary the most modern Director General or Inspector General.

Art. 2o... Incorporate as Article 29 bis of the Regulations on Qualifications, Ascense and Removals of the Staff of the Federal Prison Service, approved by Decree No. 54 of 10 January 1976 by the following:

Article 29 bis: The National Director may designate to integrate the Qualifications Boards established in Articles 26 and 29 of these Regulations to immediate staff below those provided for in these Rules and to increase the number of staff members of such boards when it is essential for the effective functioning of such boards.

Art. 3o... Authorize the NATIONAL DIRECTION of the PENITENCIARY SERVICE FEDERAL to convene, for this only time in the month of September of the current year, the Higher Board of Qualifications for the purposes set out in article 101 (a) of Law No. 20.416, in accordance with article 76, subparagraph (a) of the same legal body.
