Amendment of Decree No. 2.332/83, adapting its provisions to the industrial activities in the province of La Pampa.

VISTO Law No. 23.272, Decree No. 414 of 20 March 1986 and

CONSIDERING:

That in order to comply with the provisions of Act No. 23.272, Decree No. 414/86 entrusted the Ministries and Secretariats dependent on the National Executive Branch with the study of the rules of national order that contained provisions applicable to the entire area composed of the Provinces of Río Negro, of Chubut, of the Neuquén, of Santa Cruz and the National Territory of the Tierra del Fuego, Anmpatártida and the South Islands.

Among these rules are those that, integrating the Industrial Promotion System created by Law No. 21.608 as amended by Law No. 22.876, institute the Regional Promotion Regime for Patagonia.

As a result, the Ministry of Economy ' s Ministry of Industry and Foreign Trade has analysed the inclusion of the Province of La Pampa in that Regime, taking into account the characteristics of the said Province and its relative situation with respect to the other members of the Region.

That in order to realize this inclusion it is necessary to amend Decree No. 2.332 of 9 September 1983, adapting its provisions to reach the industrial activities that take place in the Province of La Pampa.

In the process of the present, the permanent legal advisory services provided for in Article 7 (d) of Law No. 19.549 have been introduced.

That the present is determined in accordance with Article 3 of Law No. 21.608 as amended by Law No. 22.876 and in accordance with Law No. 23.272.

Therefore,

THE PRESIDENT OF THE ARGENTINA NATION

RIGHT:

Article 1 - Amend Decree No. 2.332 of 9 September 1983, as follows:

(a) Replace Article 1 with the following:

"Article 1 - Introduce yourself to the Provinces of La Pampa, Río Negro, del Neuquén, del Chubut, Santa Cruz, the National Territory of the Tierra del Fuego, Antarctica and South Atlantic Islands and the Patagones Party of the Province of Buenos Aires, the present Regional Promotion Regime, regulation of Law No. 21.608, as amended by Law No. 22,876 and in accordance with the guidelines of Law No.

(b) Replace Article 2 (a) with the following:

"a) The area of the irrigated valleys of the Provinces of Río Negro and the Neuquén, according to the delimitation made in the Law 22.465 and its regulations, the Party of Patagones in the Province of Buenos Aires and the Departments of Chicalcó, Chalileo, Loventué, Puelén, Limay Mahuida, Utracan, Curacó, Lihuel Caleúetodo Province".

(c) Add as Article 2 (i):

"i) The area of the Province of La Pampa, which includes the Departments of Rancul, Realicó, Chapaleufú, Trenel, Maraco, Conhelo, Quemú-Quemú, Toay, Capital, Catriló, Atreuco and Guatrache.

(d) Add as the last paragraph of Article 3 the following:

"The Ministry of Economy with the participation of the Province of La Pampa shall, by resolution, establish the list of industrial activities that will be considered priority for their location in that Province, which will be incorporated as Annex I, paragraph 8 of this decree."

(e) Add as Article 9.8 the following:

"8) The area referred to in Article 2(1) of this Decree:


(f) Replace Article 13 with the following:

"Article 13. - Companies undertaking or intending to undertake industrial activities not defined as priority under Article 3 in the areas set out in Article 2 (b), (c), (d), (e), (f), (h) and (i) of this Decree may receive the benefits of this regime provided that it does not constitute a priority activity in another region promoted by a regional promotion regime. Authorization may be granted on the grounds that such activity is not exclusive to the priority region; that no other location is desirable and that its installation does not constitute a certain risk to the priority region. This condition should be fulfilled in conjunction with some of the following paragraphs:

(a) To occupy at least ten (10) people and thirty percent (30%) of the inputs used are originating in the region.

(b) To occupy at least ten (10) persons and be complementary to other industries already installed in the region.

(c) To occupy at least ten (10) people and to allocate at least thirty percent (30%) of their production to export.

(d) To occupy at least twenty (20) persons.

The number of persons mentioned in subparagraph (d) may be reduced to 10 persons when, in the opinion of the Authority of Implementation, the industry to be installed is essential for the supply of goods not produced in the region or to encourage the confinement of the population directly or indirectly by the construction of housing for the latter purpose. The occupation referred to in this article is defined as stable staff with the appropriate qualification to the characteristics of the project, in relation to dependency due to the same being maintained while the promotional benefits persist."

(h) Replace Article 19 with the following:

"Article 19. - Defeat Decrees number 1,237 and 1,238, both of July 8, 1976."

Art. 2. - Exclude the Province of La Pampa from the promotional regime established by Decree No. 261 of 13 February 1985. Companies that are in the process of applying for promotional benefits for such regime, in respect of industrial projects for the Province of La Pampa, may opt for the regime of the Decree No. 2.332/83 with the modifications introduced by the present, within one hundred and eighty (180) days of publication in the Official Gazette.
