GREAT NATIONAL BOARD Decree No. 101/87 Please provide the Agency with a view to ensuring operations for the sale of grains of future existence in the terms and scope of article 9 (ii) of Decree-Law No. 6.698/63 and its amendments.

VISTO Article 9 (ii) of Decree-Law No. 6.698 of 9 August 963 and its amendments; and

CONSIDERING:

That said paragraph did not exist in the original wording of the said legal body, having been incorporated by article 7 of Law No. 21.469, providing the National Board of Grains to be the guarantor of the contracts of sale and the other commercial operations of the grains and by-products deposited in the facilities that the agency determines.

That the agency was also empowered to require security rights of the depositary and others that were required in accordance with the provisions therein.

That the subparagraph was subsequently replaced by a new text, as determined by article 1 of Law 22108, in which the expression "deposited in the facilities that the agency determines, or in transit or from such facilities" was deleted and the following terms were inserted: "at the request of the owner or operator of lifting or installation requesting the guarantee in respect of the fulfillment of its obligations...", with the same provision being maintained.

That the elimination of the requirement of the deposit in respect of grains and by-products, subject to the operations provided for in the norm, creates an interpretative doubt regarding the powers of the National Grain Board to ensure future-existing operations.

That the respective messages of lifting the above-mentioned laws do not contain grounds that clarify the matter.

That the review of the legal text arises that there are no express limitations for the Board to ensure such operations, which, on the other hand, will benefit the different sectors involved and, in particular, the producer who will obtain a better price for his merchandise.

That the National Executive Power is empowered to issue this act under the provisions of article 86, paragraph 2 of the National Constitution.

Article 1 - Please provide the National Grain Board with a view to ensuring that future grains are sold in the terms and scope of Article 9 (ii) of Decree-Law No. 6.698/63 and its amendments.
