I look at the Nros Laws. 18.037 (t. 1976) and 18.038 (t. 1980), and
CONSIDERING:
That according to the estimated variation in the overall level of the remunerations produced in relation to which it was taken into account to establish the previous mobility, provided for by Decree No. 1.096/83, and as determined by articles 52 of Act No. 18,037 (t. 1976) and 39 of Act No. 18,038 (t. 1980), it is appropriate to increase from 1 June 1983 to 12 per cent (t.
Without prejudice to the above-mentioned measures, it is considered appropriate to recompose the retirement scales that have been lagging, seeking a more appropriate relationship with the wage level of the workers in operation.
It is also considered appropriate to equip, as of 1 July 1983, the minimum monthly pensions and pensions agreed upon or to agree on by the National Provident Funds.
That, therefore, it is appropriate to increase from the precited date the minimum monthly assets of ex gratia pensions and other non-contributory benefits and the monthly availability of old-age and disability pensions that are subject to article 8 of Act No. 18,820.
Therefore,
THE PRESIDENT OF THE ARGENTINA NATION
RIGHT:
Article 1 ∙ Increase by 12 per cent (12 per cent) the retirement and pension benefits provided by the National Provident Funds.The above-mentioned increase shall be effective 1 June 1983 and shall be applied on the amount to be received as at 31 May 1983.
Art. 2o ∙ As of 1 July 1983, the retirement and pension benefits shall be equivalent to the amounts resulting from deducting from the amounts in force as at 30 June 1983, the fixed amounts composing them, which are set out below, and increase the resulting amounts by applying the following coefficients:1. Benefits under the provisions of Resolution No. 726/78 of the former Secretariat of Social Security:
Retirements: The sum of three hundred twenty Argentine pesos will be deducted with seventy-four cents ($a 320.74), and the increase coefficient will apply 1.5135.
Pensions: The sum of two hundred forty-one Argentine pesos will be deducted with seventy-six cents ($a 241.76), and the increase coefficient will apply 1.5135.
2. Benefits derived from Act No. 18,037 and its amendments that do not fall within the provisions of the above-mentioned resolution:
Retirements: The sum of two hundred and eighty-seven Argentine pesos will be deducted with nine cents ($287,09), and the increase coefficient will apply 1,4842.
Pensions: The sum of two hundred forty-one Argentine pesos will be deducted with seventy-six cents (Argentine pesos 241,76), and the increase coefficient 1,4842 will be applied.
3. Benefits under the provisions of Decree No. 662 of 27/3/81:
Retirements: The sum of five hundred forty-eight Argentine pesos will be deducted with thirty-four cents ($548.34), and the increase coefficient will apply 1,4842.
Pensions: The sum of four hundred sixty-one Argentine pesos will be deducted with seventy-six cents ($461.76), and the increase coefficient will apply 1,6350.
4. The provisions of item 2 also apply to benefits derived from Act No. 18,038 and its amendments, the date of application being prior to 1 September 1982.
The Under-Secretariat for Social Security shall issue the supplementary rules necessary for the implementation of the provisions of this point.
