NATIONAL PUBLIC ADMINISTRATION

Decree No. 586/1981

Regulations for the acquisitions or locations of property, allocation of space, provision of equipment, forms and seals, and the location of elements for administrative tasks carried out by the agencies of the National Civil Service.

VISTO Act No. 21.630 establishing the National System of Administrative Reform; and

CONSIDERING:

That Decree No. 3.981 of 29 December 1977 establishes the areas of responsibility of the Sectoral Units and Subunits in the field of organization and systems, human resources and training with the functions that are their own.

That in the stages of development of the National System of Administrative Reform, objectives are included for the optimal performance of economic resources and for the flexibility of procedures in obtaining them.

That the Sectoral Units and Subunits of Administrative Reform must intervene and advise technically through reports based on property, equipment and forms.

Therefore,

THE PRESIDENT OF THE ARGENTINA NATION

RIGHT:

Article 1 - The agencies of the National Civil Service (centralized and decentralized) shall process the acquisitions or locations of property, the allocation of space, the provision of equipment, forms and seals, and the location of elements for administrative tasks, in accordance with the standards set out in Annexes I, II, III and IV that are an integral part of the present.

Art. 2° - Amend the Rules for the Writing and Proceeding of Administrative Documentation" adopted by Decree No. 1.666 of 3 August 1978, as noted in Annex III -FORMULARS AND ONS-point I.1.3 and item II.1.2. and Annex IV - Seals - point 3. and point 4.

Art. 3° - For the only time, in the 1981 Exercise, the Sectoral Units will intervene in the same way as the one that is currently being developed for those cases whose budget execution is carried out within that period.

Art. 4° - The Court of Accounts of the Nation, through its delegations, will be responsible for monitoring compliance with the provisions contained in the present.

Art. 5° - Please refer to the Secretary-General of the Presidency of the Nation to determine by resolution the complementary, clarification and interpretative rules necessary for the better implementation of the provisions of this decree.

Art. 6° - Default of Decrees No. 504 of 17 January 1962, 6.595 of 18/08/1965, 239 of 13 January 1966 and 969 of 23 August 1966.

Art. 7° - Contact, post, give to the National Directorate of the Official Register and archvese.

Annex I

SPACE AND INMUEBLES

GENERAL SPECIFICATIONS

1. It will include:

- Transfer of property.

- Space allocation.

- Acquisition of properties.

- Location of properties.

2. The above-mentioned cases, aimed at the development of administrative and technical support tasks, will be handled by the National Civil Service (centralized and decentralized) agencies only when the proceedings are accompanied by the prior informed evaluation and technical report, justifying the need, produced by the Sectoral Unit or Subunity of the Jurisdictional Administrative Reform or Organizational Units and Systems affected by similar functions.

3. The report referred to in the previous item will be produced at the time of the formulation of the budget forecasts for the financial period of its implementation, in order to be incorporated as a result of the General Budget Project for the National Civil Service.

4. To this end, projects to be submitted to the approval of the National Executive Branch or to the resolution of the Secretary-General of the Presidency of the Nation shall be received in the General Secretariat of the Presidency of the Nation - Undersecretariat of the Public Service - at least 30 days before the date of the formulation of the budget forecasts in the period prior to the period of their implementation. In the same time, cases to be approved by the higher authority of the jurisdiction should be received in the Sectoral Units for evaluation and technical report.

5. In cases of force majeure, unforeseen causes, budgetary adjustments or similar circumstances, the report provided for in the pto. 2 shall be carried out on the occasion of the cases identified, authorized by a hierarchy officer not less than undersecretary or higher authority of a decentralized agency and with the corresponding budgetary charge.

6. The petitioner must integrate the necessary documentation for the production of the respective jurisdictional technical report, including the corresponding study of space and all the information or documentation related to the case.

7. On the basis of these elements, the jurisdictional agency of the corresponding Administrative Reform will carry out its respective evaluation and technical report.

PARTICULAR SPECIFICATIONS

I - Transfer of property

1. Relations with cases in which an agency is given the precarious and free use of a tax property. It can be done between oneself or another jurisdiction.

2. The transfer of property shall be approved by the appropriate competent authority (between jurisdictions or within the jurisdiction), in accordance with the applicable rules in the matter (Countability Act, Arts. 51 and 53, and its regulations).

3. It should be taken into consideration that, while the transfer does not originate in real estate erogations, it may affect the budget indirectly, since the maintenance and services of the assigned building, as well as any other accessory expense to which it takes place, should be addressed. Its forecast and deadline will be adjusted to what is determined in points 3 and 4 of General Specifications.

II - Space allocation

1. It includes cases in which an agency or any of its units are granted in precarious and free use, premises not used by other units within the same or other building assigned to the jurisdiction to which it belongs or to another jurisdiction.

2. The allocation of space shall be approved by the appropriate competent authority (between jurisdictions or within the jurisdiction, in accordance with the applicable rules of the matter - Accounting Act, art. 51, and its regulation).

3. The allocation of space will be carried out by means of restructures, changes in working modalities, installations of new equipment or machinery and any other situation that imposes the functional dynamics of the organism and warrants an appropriate redistribution of the physical resource.

4. It should be taken into consideration that, while the allocation of space does not originate in real estate erogations, it may affect the budget indirectly, since the maintenance and services of the assigned premises, as well as all other expenses, accessory to which they give rise, should be addressed. Its forecast and time frame will be adjusted to what is determined in the ptos. 3 and 4 General Specifications.

III - Real Estate Procurement

1. It corresponds to cases in which the State, through one of its agencies, incorporates the domain of a property into its heritage. Such acquisition may be made by:

- Buy.

- Donation

- Expropriation

- Prescription

- Accession

- Avulsion

- Act of last will

- Vacant injury

- Permuta

2. In all cases where the State acquires property for purchase, donation or expropriation, it must have the express authorization of the Executive Branch, except where the acquiring agency is expressly authorized to carry out property acquisitions through each of the three above forms.

3. The documentation to be raised by the petitioner agency will be constituted by the needs programme and technical report that encourages the study of feasibility and acceptability of the property.

4. When the construction of a new building is required, the Sectoral Units or Subunits of the Jurisdictional Administrative Reform or Organizational and Systems Units affected by similar functions, will be in coordination with the user units, the respective needs programme.

IV - Location of properties

1. It includes cases in which the State, through any of its agencies, rents a property to a third party for a monthly amount and subscribes to the respective location contract.

2. The location of property (local state) shall be approved by the jurisdictional authority competent in accordance with the amount of the contract, in accordance with the rules in force in the matter (Countability Act, art. 61 and its regulations).

Annex II

EQUIPMENT

1. The agencies of the National Civil Service (centralized and decentralized) will process the acquisitions or supplies of office equipment, only when the evaluation is conducted through a previous technical report, justifying the need, produced by the Sectoral Unit or Subunity of the Jurisdictional Administrative Reform or Organizational and Systems Unit affected by similar functions.

2. The acquisition of electronic data-processing equipment should be supported by the National Executive.

3. The report to which the pto refers. 1 will be produced on the occasion of the formulation of budgetary forecasts for the financial period of its implementation, in order to be incorporated as a result of the General Budget Project for the National Civil Service.

To this end, the requirements shall be received in the Sectoral Units or Subunits grouped by General Directorate or equivalent with prioritization at least 30 days before the budget forecasts are formulated in the period prior to their implementation.

4. Exceptions shall be set out in Annex I - GENERAL SPECIFICATIONS- Point 5.

5. The technical report will contain:

(a) Detail of the equipment and sectors to be allocated.

(b) Justification of procurement or provision.

(c) General specifications to be complied with or identified in the catalogue of jurisdiction, indicating the Unit to make detailed specifications in case of acquisition.

6. The attached list includes the equipment for offices in which the intervention of the Sectoral Units corresponds, which will be expanded if necessary, by resolution of the Secretary General of the Presidency of the Nation.

7. The locations of elements for the development of administrative tasks will adjust their task to what is established in the present for the acquisition of equipment.

I - Forms

I. Intervention

1.1. The Sectoral Units and Subunits of Administrative Reform or Organizational and Systems Units affected by similar functions, will jurisdictionally intervene in the 4 stages that make the issue of forms.

- Analysis

- Design

- Printing

- Control.

1.2. Such units shall give their prior conformity to the printing or reprinting of forms in their functional aspect and needs.

1.3. The st is modified. 6.3.7. of Decree 1666/1976, changing Decree 6595/1965, by the number of the present and henceforth will say: "Responsibility of the Sectoral Units and Subunits of Administrative Reform or Organizational Units and Systems affected to similar functions: Analysis, design, implementation and control of forms.

2. Classification

2.1. The forms will be classified in:

(a) General use

(b) Specific use

2.2. It is called "general-use journals" those that are produced to be used in various forms for all units such as: Memorandums, paper for notes, decrees, resolutions, etc. and all other similar.

2.3. They are called "specific use forms" those designed by a dependency for supporting a particular information.

3. General use forms

They will meet the following requirements:

3.1. Standards

3.1.1. The entire general forms used in the National Civil Service (centralized or decentralized) agencies will be printed in accordance with the final formats set out by IRAM Standard 3001.

3.1.2. They will also comply with the provisions in this regard with the "Rules for the Writing and Diligence of Administrative Documentation", approved by Decree 1666/1978.

3.1.3. With regard to forms for memoranda, reports, etc. for internal use, it will only be printed the necessary basic design of it, without membership, in the same type of paper as the blank note.

3.2. Registration and control:

3.2.1. The Sectoral Units and Subunits of Administrative Reform or Organizational and Systems Units affected by similar functions will carry a record of the general forms of the distribution.

3.2.2. The units mentioned in 3.2.1 will implement the consumption control system that they consider most appropriate.

3.2.3. To this end, the Jurisdictional Supply Body shall transmit to the above-mentioned units the requirements, at least 30 days before the date of the formulation of the budget forecasts in the period prior to their implementation, in order to allow their incorporation as a result of the General Budget Project for the National Civil Service.

3.2.4. Exceptions shall be set as set out in Annex I - General Specifications- Point 5.

4. Specific use forms:

4.1. Analysis and design:

4.1.1. All forms used in the National Civil Service (centralised and decentralized organizations) will be carried out in compliance with the final formats set out by IRAM Standard 3001.

4.1.2. The same rules will include all the papers, cartulins and cartons that are acquired throughout the National Civil Service.

4.1.3. The design analysis will take into consideration all the functional and economical elements that correspond to what is evaluated in the respective analysis stage.

4.2. Printing:

4.2.1. The form may be implemented on a provisional or permanent basis.

In the first case, forms of an exception, experimentation or test procedure will be included.

The second group is responsible for the support of information in definitive processes or systems.

4.2.2. The Sectoral Units and Subunits of Administrative Reform will assist in the implementation of the forms by providing the necessary technical assistance for their correct implementation and by providing advice on their improvement.

4.3. Control:

4.3.1. The Sectoral Units and Subunits of Administrative Reform or Organizational and Systems Units affected by similar functions will implement the registration and control system that they deem most appropriate.

4.3.2. A periodic review will be undertaken for maintenance, improvement, deletion or replacement so that it is at all times an optimal medium and information support.

4.3.3. To this end, whenever an impression or reprint is made, it must be intervened by the Sectoral Units and Subunits of Administrative Reform or Organizational and Systems Units affected by similar functions.

4.3.4. In order to comply with the above-mentioned units shall receive the respective requirements, grouped by General Directorate or equivalent, at least 30 days prior to the date of the formulation of the budget forecasts, in the period prior to their implementation, in order to allow their incorporation as a result of the General Budget Project for the National Civil Service.

4.3.5. The exceptions will be set out in Annex I - General Specs- pto. 5.

II - envelopes

1. Standards

1.1. The total number of envelopes used in the National Civil Service (centralized and decentralized) agencies will comply with the IRAM Standard in all its parts.

1.2. The st. 7 of the "Rules for the Writing and the Proceeding of Administrative Documentation", approved by Decree 1666/1978, the measures being amended according to the precited Regulation IRAM.

2. Registration

2.1. The Sectoral Units and Subunits of Administrative Reform or Organizational and Systems Units affected by similar functions will carry a record of the envelopes in the distribution.

3. Control

3.1. The Units mentioned in 2.1 will implement the consumption control system they consider most appropriate.

3.2. To this end, the jurisdictional supply body shall transmit to the above-mentioned units the requirements, at least 30 days prior to the date of the formulation of the budget forecasts in the period prior to their implementation, in order to allow their incorporation as a result of the General Budget Project for the National Civil Service.

3.3. Exceptions shall be set as set out in Annex I - General Specifications- Point 5.
Annex IV

SELLOS

1. The Sectoral Units and Subunits of Administrative Reform or Organizational and Systems Units affected by similar functions will jurisdictionally intervene in the analysis and design of seals not contemplated in the rules imposed by Decree 1666/1978.

2. With regard to design, the functionality in the distribution of data should be taken into account, which is compatible with the use and handling of data, reducing the registration to a minimum.

3. The st is modified. 8.15. Other seals, of the "Rules for the Writing and Proceeding of Administrative Documentation" approved by Decree 1666/1978 , replacing "Organization and Jurisdictional Methods and Organizing Agency that Makes Their Time" with " Sectoral Units and Subunits of Administrative Reform or Organizational Units and Systems Affected to Similar Functions".

4. The pto is extended. 8.1.1 of the rules referred to in the preceding paragraph that the professional qualification to be included in the respective qualifications, issued by national universities or private universities recognized by the Government of the Nation, which shall be endorsed by the corresponding Administrative Personnel Service.

In addition, the titles of another nature will be supported through the aforementioned unit in cases where the character or performance of the function makes its use essential.
