MULTAS Updating the minimum and maximum amounts of the penalties for taxable fines and for revenues or previous deposits required for the granting of appeal and the closing day equivalences provided for in Act No. 21.845. DECEMBER No. 917

VISTO file No. 12,779/81 of the registration of the former State Secretariat for Trade and International Economic Negotiations and Decree No. 1,590 of 8 August 1980, which updates the amounts of fines provided for in various laws whose national enforcement authority is currently the Ministry of Trade and Maritime Interests, and

CONSIDERING:

Having completed the term of twelve (12) months since 9 February 1980, the date of the update established by Decree 1.590/80, it is necessary to update again the amounts of the penalties of fine and of prior income or deposits required for the granting of the appeal, determined in the respective articles of the Nros Acts. 17.016, 17.088, 18.425, 19.227, 19.511, 19.597, 19,982, 20,680 and 22,262, excluding Act No. 12,906, as a result of being repealed by the latter.

It is also advisable to update the minimum and maximum amounts of the fine penalty provided for by Decree-Law No. 4.686/58, ratified by Law 14.467 and replaced by Law No. 21.979, against violations of the provisions relating to export and import trade.

That Articles 3 of Law 21.845, 2 of Law 21.979 and 45 of 22,262, empower the National Executive to update the reference amounts on a biannual basis, based on calculation of the variation recorded in the Price Index for Major, general level, made by the National Statistical and Census Institute.

That for reasons of decentralization and effectiveness and in the exercise of the authority of delegation that agrees to the Executive Branch Article 14 of Law No. 22,450, it is advisable to entrust that attribution to update such amounts to the Ministry of Trade and Maritime Interests.

Therefore,

THE PRESIDENT OF THE ARGENTINA NATION

RIGHT:

Article 1 s Please update the amounts of the fines provided for in article 1 of Act No. 21.845 for the following amounts:

(a) Acts 17.016 (art. 2); 17.088 (art. 5); 18.425 (art. 22); 19.227 (art. 28); 19.511 (art. 33); 19.597 (art. 72); 19.982 (art. 12); and 20.680 (art. 5): fine of two hundred and seventeen thousand forty pesos ($ 217,040) to two hundred and seventeen million pesos ($ 217.040). .

(b) Law 20,680 (article 9): fine up to five hundred forty-two thousand six hundred pesos ($ 542,600).

Art. 2o s Please update the amounts of the prior income or deposits required for the granting of appeal and the closing day equivalencies provided for in Article 2 of Law No. 21.845, corresponding to the following laws:

(a) Act 20,680 (article 19): the term of the closure shall be set between one hundred and eight thousand and five hundred twenty pesos ($ 108,520) and two million seven hundred and thirteen thousand pesos ($ 2,713,000).

(b) Act No. 19.597 (article 84): a prior deposit of 20 per cent (20 per cent) of the fine imposed or two hundred and seventeen million forty thousand pesos ($ 217.040.000), if the latter were greater.

(c) Laws 18.425 (article 23) and 19.982 (article 17): prior income of one hundred and eight thousand five hundred twenty pesos ($ 108.520).

Art. 3o . Update the amounts of the fines provided for in articles 16, 26 c, 28 and 42 inc. 1 ap. b and inc. 2 pursuant to Law 22.262 for the following amounts:

(a) Art. 16: a fine of up to eleven million eight hundred and thirty thousand pesos ($ 11,830,000).

(b) Art. 26 inc.: fine of five hundred ninety-five thousand five hundred pesos ($ 591,500) to a thousand seven hundred seventy-four million five hundred thousand pesos ($ 1,774,500.000).

(c) Art. 28: daily fines of up to seventeen million seven hundred forty-five thousand pesos ($ 17.745,000).

(d) Art. 42 inc. 1 ap. b: fines of one million seven hundred seventy-four thousand five hundred pesos ($ 1,774,500) to three thousand five hundred forty-nine million pesos ($ 3,549,000.000).

(e) Art. 42 inc. 2 a: fines of one million seven hundred seventy-four thousand five hundred pesos ($ 1,774,500) to three thousand five hundred forty-nine million pesos ($ 3,549,000.000).

Pan. 4o ). Please also update the minimum and maximum amounts of the fine penalty provided for in Article 1 of Decree-Law No. 4.686/58; ratified by Law No. 14.467 and replaced by Law No. 21.979, for the amounts of three hundred forty-five thousand twenty pesos ($ 345.120) and three hundred and fifty-nine million five hundred thousand pesos ($ 359.5 million).

Art. 5o la Delegate to the Ministry of Trade and Maritime Interest the authority to six monthsly update the amounts specified in the previous articles of this Decree, according to the basis of calculation provided for in Articles 3 of Law No. 21.845, 2 of Law No. 21.979 and 45 of Law No. 22.262.
