Apply the necessary measures for the proper realization of the works of the Pesada Water Plant to be erected in the town of Arroyito, Neuquen province.

CONSIDERING:

It is advisable to take the necessary measures for the proper realization of the works of the heavy water plant to be erected in the town of Arroyito, Province of Neuquén.

Therefore,

THE PRESIDENT OF THE ARGENTINA NATION

RIGHT:

Article 1 - Please remind the National Atomic Energy Commission of the authority to appoint and hire the necessary personnel required for the construction, commissioning and operation until the final reception of the heavy water plant to be installed in the Province of Neuquén, and to establish the working conditions to which it will be subjected, giving an annual account of this to the Executive Branch.

Art. 2o - The National Atomic Energy Commission may establish delegations abroad for the time required by the management, coordination and control of the work carried out for the implementation of the contracts for the construction of the heavy water plant to be installed in the Province of Neuquén. It may also send directly abroad, transfer or receive from abroad the staff that it considers necessary for the direction, coordination, study and control of general or particular aspects of the work, giving a biannual account of this to the Executive Branch.

Art. 3o - Determine as a direct forced dispatch to the square, the equipment, machinery, materials and elements that are introduced for the heavy water plant to be installed in the Province of Neuquén, the National Atomic Energy Commission or the company awarded of the plant.

Art. 4o - The introduction of the goods specified in the preceding article shall be made by the regime of dispatch to square on request, however the shipper shall declare the goods, in accordance with the Nomenclature Tariff and Import Rights (N.A.D.I.).

Art. 5o - For the purposes of compliance with Article 13 of Decree 5344/64, the National Atomic Energy Commission or the awarding firm shall submit the certificates of the imports made for the construction and commissioning of the heavy water plant to be installed in the Province of Neuquén, within the period of ninety (90) days from the date of dispatch to square of the goods concerned.

Art. 6o - The provisions of Articles 3, 4 and 5 shall apply to materials that are not included in the positive list of supplies and spare parts of local origin, which, on the proposal of the National Atomic Energy Commission, establishes by resolution the Ministry of Economy. Such a resolution should be adopted within thirty (30) days of the submission of the proposal by the National Atomic Energy Commission.

Art. 7o - The customs or receiver who receives a request for the issuance of a place under the conditions provided for in this decree shall give priority to the procedure and shall send a copy of the dispatch made to the Industrial Development Secretariat, which in turn will present it as a precedent to the Honorary Advisory Commission of Decree-Law 5,340/63.

Art. 8o - The National Customs Authority shall authorize the introduction of goods in temporary admission, upon delivery of a letter of guarantee in its favour, delivered by the National Atomic Energy Commission and accepted by the company that awarded the works of the heavy water plant. The National Atomic Energy Commission shall notify the National Customs Directorate of the date of the final reception of the heavy water plant.

Art. 9o - All customs checks will be carried out in the ports and airports of arrival of the materials for all those goods that allow correct and thorough verification. When due to its quantity, variety, volume or weight, this is not possible, the verification will be done directly at the facilities of the heavy water plant in the Province of Neuquén, to where the goods will be carried with the corresponding custody.

Art. 10. - The destination control of the corresponding import goods will be carried out by the National Customs Directorate in coordination with the National Atomic Energy Commission.

Art. 11 - All matters relating to the recruitment, project, execution and control of the works shall be carried out by the National Atomic Energy Commission as a statutory enforcement agency. The president of the National Commission shall be responsible for the subscription of any documentation necessary for such purposes. The contract with the procuring company of the heavy water plant to be installed in the Province of Neuquén shall be subject to approval by the Executive.
