DECEMBER No. 232/79 MINISTERIES AND SECRETARIAT OF STATE Rules for the preservation of the various archives of the public administration.

Buenos Aires, January 29, 1979.

VISTO the need to put in order and coordination in all matters concerning the situation of the various archives of the national civil service, especially in the field of document conservation, microfilmation and its destruction and,

CONSIDERING:

That Act No. 15,930 provides for the supervision of the General Archive of the Nation over all administrative archives of the Nation (article 4 (d and (e)), but does not provide for time-frames or the possibility, admitted by modern archivistic science, of the destruction of useless papers.

There are no general rules establishing the criteria for the keeping, temporary and/or finalization of documents or providing for cases in which they may be destroyed, nor for identifying those responsible for deciding on such destruction.

That the elimination of useless documents and the preservation of those useful for the administration or historical value cannot be delivered to the arbit of officials without archivistic training.

That the particular rules in this regard possess some agencies do not obey common principles and do not have harmony or correlation between them.

That this situation can lead to the loss of valuable documents, both from the point of view of the interest of the State and from the perspective of the investigation of history or other scientific provisions.

That the Directorate-General of the General Archive of the Nation under the Ministry of the Interior is developing, together with the Under-Secretary of Public Service, the draft general rules that will lead to coordinated action in this area.

Under Decree No. 3244/1977, the Under-Secretary of Public Service under the General Secretariat of the Presidency of the Nation is the Central Unit of the National Administrative Reform System referred to in Act No. 21.630.

That the law prescribed agrees to the Central Unit the powers necessary to coordinate and modernize the various services of the administration, so it has a natural competence to intervene in this matter.

Therefore,

THE PRESIDENT OF THE ARGENTINA NATION

RIGHT:

ARTICLE 1 The Ministries and Secretariats of State (centralized and decentralized administration, State enterprises and societies, special accounts services and social works), shall submit to the consideration of the General Secretariat of the Presidency of the Nation (Subsecretariat of the Public Service) any draft measures to propose or dictate ¬ according to the case- on their respective archives and that it relates to the discarding of documents, micro/fil.

ARTICLE 2 The General Secretariat of the Presidency of the Nation (Subsecretariat of the Public Service) shall, in each case, require the opinion of the General Directorate of the General Archive of the Nation regarding the projects referred to in the preceding article.

ARTICLE 3 The provisions of article 1 shall not apply when it comes to measures initiated in the General Archive of the Nation and relating to its internal scope. The actions planned to be issued or proposed by the General Archive for application outside its area should be brought to the attention of the Under-Secretary of Public Service, through the Ministry of the Interior, to ensure proper coordination in the actions of both units.

ARTICLE 4 Communicate, publish, from the National Directorate of the National Registry of the Official Register and archvese.
