EXTERIOR TRADE DECADE N° 637/1979 Standards to facilitate shipment of goods abroad in appropriation. Bs. As., 6/3/79
Having regard to Case No. 101.897/78 of the Registry of State of Commerce and International Economic Negotiations, and
CONSIDERING:
It is considered appropriate to arbitrate measures that enable the establishment of a mechanic to facilitate the shipment of goods abroad in appropriation.
That through this regime will be channeled the realization of subsequent export operations, allowing the access of various products to potential markets.
That, for this purpose, it is considered appropriate to take measures to simplify the efforts that exporters must make, granting the facilities provided for in articles Nros. 133 and 141 of the Customs Act (T.O. in 1962 and its amendments) their regulatory texts given by Nros Decrees. 7.069 of 13 October 1972 and 3.109 of 24 May 1972 respectively, and other precedents for which similar situations were resolved, such as Decree No. 4.534 of 17 May 1973.
That the Directorate-General for Legal Affairs of the Secretary of State for Trade and International Economic Negotiations took the appropriate intervention.
That the proposed new rule should be set out in Act No. 20.546.
Therefore,
THE PRESIDENT OF THE ARGENTINA NATION
RIGHT:
Article 1 - The exporters may carry out shipments abroad as a consignment, of all the goods covered by the Common Nomenclature of MERCOSUR (NCM).
(Article replaced by art. 1 Decree No. 975/1998 B.O. 24/08/1998) Art. 2o - The period of the appropriation shall not exceed the TRESCIENTA SESENTA (360) days, counted from the date of the officialization of the respective shipping permit to the General DIRECTION OF ADUANAS, dependent on the FEDERAL ADMINISTRATION OF PUBLIC INCOMES, autarchical entity within the scope of the MINISTERIO DE ECONOMIA.
The MINISTERY OF PRODUCTION shall determine particular time limits, depending on the characteristics and conditions of marketing of the different productive sectors which, in no case, may exceed the maximum limit set out in the preceding paragraph. After the time limit of the appropriation has not been specified the sale, the return of the goods must be made, for which only an additional period of SESENTA (60) days will be provided.

Watch: from the day after the date of publication in the Official Gazette) Art. 3o - The sale abroad of goods under the protection of art. 1st of the present decree, the exporter shall communicate this circumstance to the National Customs Administration, proceeding to enter the respective currency countervalor, in accordance with the rules of the Central Bank of the Argentine Republic in force at the date of the operation.
Art. 4o - Merchandises whose sale is made pursuant to this decree will benefit when it corresponds to the export promotion regimes and the respective level of profits in force at the date of the officialization of the boarding permit and these will be required after the entry of the corresponding countervailing in currency.
Art. 5o - The additional reimbursement of 5 per cent for exports to markets considered non-traditional will also be applicable as long as the exporter makes the relevant order before transforming the appropriation into final sale, and meets the requirements of Decrees No. 2863 of 15 May 1972 and 3442 of 14 November 1977.
Art. 6o - Those who violate the provisions of this decree by false demonstration, act or omission to devise the purpose of the regime established shall be liable to the exclusion of the Register of Exporters and Importers. (Decree No. 604 of 28 January 1965), without prejudice to the penalties laid down in the Customs Act (T.O. 1962) and its amendments and also the penalties provided for in Act No. 19,359.
Art. 7o - The National Customs Administration will forward to the State Secretariat for Trade and International Economic Negotiations (National Export Directorate) a copy of the shipping permits for the goods dispatched under this regime.
Art. 8o - The provisions of article 1 of this Decree do not extend to products whose export is prohibited or suspended.
Art. 9o - The present decree shall begin to govern from the thirty (30) days of its publication in the Official Gazette, within which time the National Customs Administration shall regulate its rules of application.
