VISTO Act No. 17.741 (as amended by Acts No. 20.170 and 21.505) and Articles 10 and 11 of Decree No. 1.405/73 and
CONSIDERING:
Article 1 of Act No. 17.741 (modified by Acts No. 20.170 and 21.505) provides for the promotion and regulation of film activity by the National Film Institute
That article 2 of the above-mentioned legal body, in its subparagraphs (a) and (f), points to the functions and powers of that body in order to formulate and execute measures to promote the development of Argentine cinematography and empowering it to administer the Film Development Fund.
That the National Institute of Cinematography proposes to adapt the regulations that set the per hundred or indices regarding subsidies for display of long films.
It is considered the convenience of benefiting those producers who commercially released their films during the year 1978.
That the National Institute of Cinematography has its own resources that allow it to absorb emerging expenses.
It is beneficial for the national film industry to reduce the proportion of reinvestment subsidies and in accordance with articles 36 of Act No. 17.741 (as amended by Act No. 20.170 and 21.505) and Articles 10 and 11 of Decree No. 1.405/73.
Therefore,
THE PRESIDENT OF THE ARGENTINA NATION
RIGHT:
Article 1 - Amend article 10 of Decree No. 1.405/73 to read as follows:
"See in a 50 (50) percent of the tax collection that will be allocated in each financial period to attend to the exhibition grants of long-term national films, under the conditions listed below:
(a) Movies without interest, especially: Basic cost index recognized by the National Film Institute: Seventy-five (75) per cent.
Percentage subsidy: Forty-five (45) in premiere rooms; thirty-five (35) when the film is the basis of the program, ten (10) when the film integrates the program as a complement.
If the add-on is made up of more than one long film entitled to subsidy, this percentage will be divided equally.
(b) Special interest films:
One hundred percent of the cost recognized by the National Film Institute.
Additional subsidy percentage: Five (5) when the film is the basis of the program.
Art. 2o - Amend article 11 of Decree No. 1.405/73 to read as follows:
"The subsidy will be paid to the producer for reinvesting in a new film, or in industrial equipment, when the liquidations for this concept exceed in the subsidized film seventy (70) percent of the cost for films with special interest and ninety-five (95) percent of the cost for films with special interest.
It will be liquidated prior approval of the respective project of production and recognition of the budget of the new film and verified the realization of the first week of shooting.
Reinvestments for industrial equipment will be intended for the acquisition of new machines, equipment, instruments and accessories, without use, and for direct application in the production of films.
Art. 3o - These provisions will apply and benefit those national producers whose films have been subsidized and commercially released since 1978.
