VISTO; the draft Regulations on Qualifications, Ascense and Removals of the staff of the Federal Prison Service, elevated by the National Directorate of the Federal Prison Service and proposed by the Ministry of Justice of the Nation to which it depends, and
CONSIDERING:
That the new organizational structure given to the Federal Prison Service by its Organic Law (Decree-Law No. 20.416/73) requires the gradual adjustment of the regulations of that Security Force to the same.
That the draft reference replaces the text of Decree No. 1.620/73 in force to date, aligning it with the legislation established by Decree-Law No. 20.416/73.
Therefore,

Article 1 Artículo Approved the "Regulation of Qualifications, Ascense and Removals of the Staff of the Federal Prison Service", regulation of Chapters IX .Califications y and X .Ascensos. of the Organic Law of the Federal Prison Service (Decree Law No. 20.416/73) acting as fojas dos (2) to fojas twenty (20), whose text is an integral part of this decree. QualificationsArticle 1 . The rating of prison officers shall be annual and shall be confidential. It will take place on 15 September each year.
Art. 2o Las The modifications that are made from the 16th of September and up to five (5) days before the completion of the tasks of the respective Qualifications Boards with reference to the impediments to promotion, as set out in article 84 of Decree Law No. 20.416/73, shall be previewed by radiograms by the Chief, within twenty-four (24) hours of the notice produced, to the respective board without confirmation. The subsequent modifications and up to the date of elevations of the promotion proposals shall be communicated to the Directorate-General of the Prison Corps by the same tracks and shall be taken into account by the National Directorate for the relevant purposes.
Art. 3o Art The National Director will first and only qualify the Inspectors General in activity that integrate the Planning and Coordination Council, the Directors Generals and Directors of the Higher Agencies of·Execution and the holders of the Assistant Authorities of Conduction and second qualification to the Heads of Region, the Director of the Higher Academy of Penitentiary Studies, the Director of the School of Prisons
Art. 4o . The Heads of the Region shall firstly qualify the Directors of Dependent Units and the officers of the Senior Staff belonging to their respective assignments with direct dependence on them; and secondly the officers of the Senior Staff who are first qualified by the holders of Dependent Units and Services.
Art. 5o . The Director-General of Administration shall secondly qualify the Administrative Heads of Agencies and Units.
Art. 6o agente The penitentiary agent will be qualified in two instances, in the first one he will qualify the direct Chief (Personal Superior), and in the second Chief Superior Immediate, according to the organizational structure of the unit where he reviews. Where, in the opinion of the National Director, the small number of troops prevents the dual qualification, the agent may be qualified, as an exception, in one instance.
Art. 7o . They may not act as qualifiers who have had the agent or agents at their disposal for a time less than three (3) months, or who are linked to them by consanguineous kinship bonds up to four degrees or second by affinity. Any such circumstances shall be appropriated in the respective qualification report.
Art. 8o de In addition to the annual qualification (Art. 1o), the agent will have partial qualifications, when they measure the following circumstances:
(a) Change of destination and/or function of the agent;
(b) Change of destination and/or direct chief function;
(c) Incorporation of the agent or his direct head as a pupil to the Institute or Training Course, with relay of the role he plays.
Art. 9o Art The partial qualification will consist from the previous one, whether annual or partial, until the day of the cause that originates it.
Art. 10. El The Chief who produces the last annual qualification will average the qualifications that the agent has during the qualifying period and will proceed to the closing of the annual report, also consigning a synthetic, literal, judgment on the qualification.
Art. 11. . The direct Chief shall raise the annual or partial qualifications by the end of the annual period, before the day 15 of September of each year or the next working day if it is traded, the corresponding chief, who before the 25 of the same month or the next working day if it is traded, shall conclude the review and notification procedure of the qualified. The Chief shall refer such qualifications to the Directorate-General of the Penitentiary Corps, before September 27.
In cases of partial qualifications provided for in Art (a), (b) and (c). Eighteenth, the direct head, within twenty-four (24) hours of the act that motivated them, shall perform the qualifications and shall lift them to the superior head, who shall, within twenty-four (24) hours, proceed to the notice of the agent. When originated by transfer of the person, the partial qualification will be forwarded to his new destination, together with the personal legajo, within five (5) days of the agent's pass.
Art. 12. . The qualifications of the respective instances will be independent of each other, the final qualification being the result of averaging the partials that the agent might have had, during the qualifying year, including the closing of the qualifying report.
Art. 13. La The National Directorate will establish the individual qualification sheet and the relevant forms and provide the instructions to which the qualifications should be adjusted.
Art. 14. . With the qualification report, the forms, the resources, reports and all other precedents, each agent will form an annual individual performance of qualifications.
Art. 15. El The rating report will be headed by a grid with the following data and background of the agent:
(a) Antiquity in grade and in institution;
(b) Functions performed during the qualification period and their character (title, acting or accidental);
(c) Congratulations and notes of merit;
(d) Disciplinary sanctions, as well as any demerit note with the expression of their causes;
(e) Justifiable or unjustified inassisbilities, parts of the sick and extraordinary licenses;
(f) Availability, reasons and duration;
(g) Destinies, functions, commissions, subscriptions, transcripts in chronological order, with reference to official documentation;
(h) Synthesis of concepts referred to in inspection reports and documents, which credit merits or mean demerit for the agent, in his service management;
(i) Honorary or meritory distinctions and designations obtained by the agent as soon as they are linked to the prison function;
(j) Meritory qualifications and mentions, or disapproval obtained in courses, works, tests or competitions, in which they intervene because of their function, the requirements of training, information or improvement.
(k) Its economic background (embargo, breach of certified obligations, etc.), indicating whether or not there was a sanction.
Art. 16. La The qualification will see the following basic subjects:
(a) CAPACITY (intellectual data and general, professional and specialized cultural training);
(b) COMPETENCE FOR FUNTION (within its scalual and grade system);
(c) ENDANCE (dedication, production and functional effectiveness);
(d) CONDUCTA (ethical content of its behaviour in the Service);
(e) APTITUDES FISICAS (in relation to the role it plays or to play for progress).
Art. 17. La The rating will be numerically evaluated and will range between zero (0) and one hundred (100) points with the following conceptual correspondence:
from zero (0) to thirty-nine (39) מרווווה. Enough
from forty (40) to forty-nine (49).
from fifty (50) to fifty-nine (59). Okay.
from sixty (60) to sixty-nine (69) . . . .
from seventy (70) to seventy-nine (79) oriented toward becoming the most influential participant.
from eighty (80) to eighty-nine (89) מווווה. Excellent.
from ninety (90) to one hundred (100) . become the breadwinner of the economy.
Art. 18. Cada Each item of the subjects provided for in Article 16 will be qualified with integers; by means of such numerical qualifications the "Synthetic Concept" will be obtained. The qualification report will be completed with a specific valued judgement of the professional skills and moral conditions of the agent, formulated by the qualifiers.
Art. 19. El The "Synthetic Concept" will produce the following effects:
(a) "Outstanding", "Excellent", "Distinguished" and "Very Good" declare the agent "fit for the immediate higher degree";
(b) "Well," declares the agent "fit to remain in grade";
c) "Deficient" and "Regular" declare the agent "decreased in his ability to remain in grade."
Art. 20. . The agent will be notified on record of any annual or partial qualifications. It may take note of the same and of the specific judgment formulated, and it is forbidden to make any observations in that act.
Art. 21. la The qualification may be filed, following the hierarchical path, in writing in the time and form determined:
(a) In the first instance, before the owner of the relevant agency, of those mentioned in the numbers 4 to 10 of Article 7 of Decree Law No. 20.416/73, within five (5) days of notification. The remedy shall be settled within five (5) days of receipt;
(b) Ultimately, before the National Director of the Federal Prison Service, within five (5) days of the notification of the first instance ruling. The remedy must be resolved within five (5) days of receipt.
Art. 22. . Agents who have been qualified in one or the last instance by the National Director may file a reconsideration appeal with him within five (5) days of his notification.
Art. 23. . Resources should be founded, styled and formulated in respectful terms of the hierarchy. They should indicate whether other resources were previously filed and in no way may contain comparative trials with other actors. Failure to fill these precautions will be dismissed.
Art. 24. La The simple interposition of the remedy, even if it is dismissed, will not motivate disciplinary punishment unless the commission of a statutory fault arises from its text. In that case, without prejudice to the appropriate procedure, once the latter has been completed, disciplinary power shall be exercised.
Qualifications BoardsArt. 25. La The senior board of qualifications referred to in article 76 (a) of Decree Law No. 20.416/73 shall be chaired by the National Deputy Director and composed of the Inspector Generals in operation, acting as secretary of the most modern Inspector General.
Art. 26. La The Staff Qualifications Board referred to in article 76, subparagraph (b) of Decree Law No. 20.416/73, shall be chaired by the National Deputy Director and composed of the Directors of Labour and Production, Social Work, General Secretariat, Higher Academy of Penitentiary Studies, Penitentiary School, Units, Head of the Accounting Division, Prefects of the General Corps Scaffolding, except that chaired by the Sub-Commissioner In plenary meetings, this Board will begin its work, first dealing with the Order of Merit of the highest-ranking agents and so on in a decreasing order of the hierarchical scale to consider.
Art. 27. de In order to carry out its mission, the senior staff qualifications board will constitute working commissions that will consist of the following:

Art. 28. ; When the agents are considered ordained in their respective scallops and subscalaphones, they will intervene as "Ad-hoc" members;
(a) ADMINISTRATIVE SCALAFON:
Cuatro Four (4) Senior Officers under Inspector General or Chief Officers appointed by the National Directorate;
(b) PROFESSIONAL SCALAFON:
Director of Audit General, Director of the Institute of Classification and Heads of Divisions: Medical Assistance, Education, Social Assistance, Spiritual Assistance and Construction.
Art. 29. La The Junior Staff Qualifications Board referred to in Article 76, paragraph (c) of Decree Law No. 20.416/73, shall be chaired by a Prefect of the General Corps Scaffolding consisting of a Subprefect of the same scale, by twenty (20) Chief and Officer Officers acting in the grade of Chief Adjutor and five (5) Senior Officials of the General Corps Scaffolding, appointed to the effect
Art. 30. de In order to carry out its mission, the Sub-Alternate Staff Qualifications Board shall constitute working commissions, which shall consist as follows:

Art. 31. , When the agents of the Professional Scaffold are to be considered, "Ad-hoc" members of the respective Subscalafons will intervene as follows:
(a) SUBESCALAFON SUBPROFESIONAL:
By a Chief or Officer of the Institute of Classification and Medical Assistance Division, and a Senior Scale Officer;
(b) SUBESCALAFON MAESTRANZA:
By a Chief or Officer of the Directorate of Labour and Production, and a Senior Scale Officer.
Art. 32. Las The three Qualifications Boards, for the purposes of promotions, will be convened by the National Directorate with sufficient anticipation to begin their tasks on October 15 or the first working day following, if it were traded and will deliberate for ten (10) working days. The members of the qualification commissions shall be relieved of their duties inherent in the post they hold during the sessions for which they were convened. The National Directorate shall inform the President of the respective Qualifications Board, the payroll of agents covered by Article 101, paragraph (c) of Decree Law No. 20.416/73, that it has agreed to continue to work and to meet the minimum time to the degree, for inclusion in the order of merit for promotion. The Higher Board of Qualifications and Board of Qualifications of the Sub-Alternate Personnel shall also be convened by the National Directorate for the purposes set out in article 101 (a) of Decree Law No. 20.416/73, in accordance with article 76, subparagraphs (a) and (c) of the same legal body, during the month of May.
When the case is given in part two of Article 79 of Decree Law No. 20.416/73, the National Directorate shall communicate to the President of the corresponding Qualifications Board, the Sub-Scaffold Scaffold and grades in which a supplementary Merit Order should be raised, which shall be incorporated after the Merit Order previously established for agents who possess the antiquity for promotion.
Art. 33. La The chairmanship of each Qualifications Board shall, within 24 hours of its constitution, set the concrete plan of work to be carried out by its members in full and by the working commissions that are formed, for the better and faster fulfillment of its mission.
Art. 34. El The quorum of the plenary meetings will be formed with the two thirds of the members of the respective Board. The deliberations will be strictly secret and their decisions will be taken by a simple majority of votes. The President will only vote on a tie.
Art. 35. . In the absence of the President of the Board or Commission, the latter shall be replaced by the highest-ranking agent, in accordance with the requirements of article 54 of Decree Law No. 20.416/73.
Art. 36. Cada Each Qualifications Board shall bear a Book of Acts, rubricated, sealed and foiled by the Directorate General of Penitentiary Corps, in which the summary of the meetings shall be recorded with the record of the decisions of the majority, and if any, of the dissents, in both cases briefly founded.
Art. 37. La The Directorate-General of the Penitentiary Corps (Personal Division) will refer to the respective Qualification Boards, together with the individual qualification sheets, the following documentation:
(a) Updated personal drawing of each agent to be considered;
(b) Nomin of all agents who meet the minimum regulatory time for promotion, by scale and by degree, with the indication of: seniority in grade and as a member of the Senior or Junior Staff, as appropriate;
(c) Nomine of agents covered by article 84 of Decree-Law No. 20.416/73, divided into each of its subparagraphs.
Without prejudice to this, each board of qualifications may collect from the Directorate-General of the Penitentiary Corps any information that is indispensable for the proper fulfilment of its mission.
Art. 38. . Within the time limit specified in article 32 .primra parte., the Directorate-General of the Penitentiary Corps shall refer to the respective Qualifications Board, all those exempt from the opinion provided for in article 77, of Decree Law No. 20.416/73.
InstructionsArt. 39. Las The three Qualification Boards convened for promotion purposes (Article 76 of Decree-Law 20.416/73), shall adjust their duties to the following instructions:
A) For the development of the tasks of the Working Boards and Commissions:
(1) Order of Merit for promotion by qualified antiquity (Article 80 of Decree Law No. 20.416/73);
(2) Order of Merit by selection (Art. 80 of Decree Law No. 20.416/73);
(3) Views in re-entry files and requests for rehabilitation of exonerated personnel (Article 77 of Decree Law No. 20.416/73).
B) For the development of the tasks of the Working Commissions ArtArticle 28 of these Rules of Procedure::
(1) It shall be chaired by the highest-ranking agent, who shall act as an informing member of the commission at the plenary meeting of the respective Qualifications Board;
(2) The reports of the commissions shall be recorded in a memorandum by duplicate, signed by all members, which shall be delivered to the President of the respective Qualifications Board;
(3) When the commissions notice errors or material omissions in the individual seal of the agents, they will proceed to place in red ink in the corresponding place the omitted data or record the annotation in it, in correct form. In all cases, in point XII (Observations), the omissions or errors saved, with reference to the source used for the collection, will also be recorded;
(4) If the observation affects the gloves at point VIII EsScale of Qualifications o or at point X -Report-Resumen,, it will formulate them again in red ink; in the first case, in the immediate line prior to the questioned figure, and in the second, to the right side of it;
(5) In all cases the annotations made shall be initialled by the Chairman of the respective Commission, who shall also bring such circumstances to the attention of the Board;
6) The Chairman of the Commission who comments in the seal of qualifications shall communicate this circumstance to the Directorate General of the Prison Corps (Personal Division) for the timely notification of the agent, which shall be made under item VII (Notifications by the qualified one), by the annotation "Junta de Calificados", date and signature of the same. On that occasion, the Personal Division or the respective sections of Agencies or Units will proceed to make the relevant modifications in the duplicate of the agent's initial seal.
C) Plenary meetings of the Boards:
(1) They shall conform to the provisions of articles 26 tima last part;, 34 and 36 of the present;
(2) Members "Ad-hoc" will only be present and will vote in plenary meetings where cases of agents who motivated their appointment are considered.
D) Order of Merit by Selection: Vote:
(1) If during the plenary meetings the Boards consider it necessary to establish by vote the Order of Merit by Selection, the following shall be acted:
(a) A payroll will be made with all agents to be considered simultaneously;
(b) Each voting member shall assign each agent to consider, according to the concept he deserves, a score following the following procedure:
The agent who in his opinion must be first shall place a score equal to the total number of agents appearing on the payroll; to whom he considers second, he shall diminish a point regarding the first and so on in the remaining cases;
(c) The voting member will sign his payroll and then the corresponding scrutiny will be performed. The agent who has gathered more points will occupy the position of the Order of Merit that is considered, and then, according to the number of points reached, the other agents will be placed successively.
Art. 40. . Within forty-eight (48) working hours of the end of the annual session, the chairs of the Boards convened for the promotions referred to in Art. 32 ,primra parte,, will raise the National Directorate, by Escalafón and by Grade:
(a) Order of merit for promotion by qualified antiquity, and/or by selection;
(b) Views in re-entry files and requests for rehabilitation of exonerated personnel (Article 77 of Decree Law No. 20.416/73).
CHAPTER II
Ascense and RemovalsArt. 41. Los The promotions referred to in article 78 of the Organic Law of the Federal Prison Service (Decree Law No. 20.416/73) will normally occur as at 31 December of each year, with the exception of:
(a) The cases provided for in articles 83 and 86 of Decree Law No. 20.416/73;
(b) When the National Director, in accordance with inescapable reasons of service, resolves or propitiates him, in compliance with the provisions established for that purpose by Decree Law No. 20.416/73 and these regulations.
Art. 42. de To be considered in the order of merit for promotion, the agent ordered in the Scale General Corps, Senior Staff, must possess, the minimum age to the degree, which is then determined:

Art. 49. El The order of merit for the promotion by qualified seniority of the Senior Staff referred to in Article 80 of Decree Law No. 20.416/73 shall be determined by the application of the following background:
(1) Antiquity to the degree;
(2) Conceptual responsibility;
(3) Antiquity in the Institution.
(a) Equality of these elements shall be taken into account:
(a) Function;
(b) Average of the last course;
(c) Numerical average of grades obtained in grade.
Art. 50. El The order of merit for the promotion by qualified seniority of the Junior Staff referred to in article 80 of Decree Law No. 20.416/73 shall be determined by the application of the following background:
(1) Antiquity to the degree;
(2) Antiquity in the Institution;
3) Conceptual Correspondence.
(a) Equality of these elements shall be taken into account:
(a) Function;
(b) Average of the last course;
(c) Numerical average of grades obtained in grade.
Art. 51. Las The payrolls of the Senior and Sub-Alternate Personnel, in order to be considered by the respective Qualifications Boards, for the formulation of the merit orders by qualified seniority (Articles 49 and 50 of these Regulations), shall be made by the Directorate-General of the Prison Corps (Personal Division), based on the following background:
For the Senior Staff:
1 ; Antiquity in grade;
2 ; Conceptual Correspondence;
3 . Antiquity in the Institution.
For junior staff:
1 ; Antiquity in grade;
2 ; Antiquity in the Institution;
3 . Conceptual Correspondence.
Art. 52. . For the purposes of Article 49(3), only the time the agent reviewed as a holder shall be taken into account in the grade of the hierarchical scale of the Senior Staff.
Art. 53. . For the promotion by selection of the Senior and Sub-Alternate Personnel, in the corresponding grades and scales (Article 81 of Decree Law No. 20.416/73), the synthetic concept will be taken into account (Article 17 of this Regulation), which should not be less than Excellent.
On the basis of the Synthetic Concept, the concept that the agent deserves of the qualifications board will prevail.
Art. 54. . According to the Merit Orders formulated by the Higher Board of Qualifications and Qualifications Boards, the National Directorate will propose promotions, or will promote the appropriate agents.
Art. 55. ; In accordance with Article 101, paragraph (a) of Decree-Law No. 20.416/73, the minimum number of vacancies in the grades to be co-continued shall occur on an annual basis, provided that for other reasons they are not motivated;
PERSONAL SUPERIOR

Art. 56. . When the provisions of article 55 apply, the Higher Qualifications Board and the Sub-Alternate Staff Qualifications Board, as appropriate, shall consider all agents in the Scaffolding and the degree to which vacancies should occur.
Art. 57. El The National Director, in accordance with the payrolls presented by the respective Boards (Articles 55 and 56), will resolve accordingly.
Art. 58. El The claim referred to in article 85 of Decree-Law No. 20.416/73 must be filed in writing and following the hierarchical pathway. If there is a claim to consider, the National Directorate will convene the qualifications board for the first working day of March.
Art. 59. . Authorize the National Directorate of the Federal Prison Service to resolve, on the basis of the provisions of the Organic Law of the Federal Prison Service (Decree Law No. 20.416/73) and those of this Regulation, the situations not provided for in it, in terms of qualifications, ascense and eliminations.
Art. 60. El The Order of Merit of the Subscalafons of the Professional Scaffold (Personal Superior), will be formulated according to the following specialties:
(a) Criminology:
1 ; Psychiatrists with criminological versation;
2 ; Physicians with criminological versation;
3 ; Lawyers with criminological versation;
4 ; Psychologists;
5 ; Sociologists;
6 . Former technical assistants.
(b) Health:
1 ; Physicians;
2 ; dentists;
3 ; Biochemicals;
4. Pharmaceuticals;
(c) Social Service:
1 . Social assistants and other social service professionals.
(d) Legal:
1 . Lawyers.
(e) Teacher:
1 ; Teachers;
2 ; Libraries;
3 ; Physical Education Teachers;
4. . Music professors.
(f) Clergy:
1 . Chaplains.
(g) Work:
1 : Engineers:
2 ; Veterinaries;
3 ; Industrial and agronomist technicians incorporated by the National Prison School;
4 . Other technicians with an enabling degree at the secondary level of agricultural and industrial education.
(h) Construction:
1 ; Engineers;
2 ; Architects;
3 . Masters of Works.
