DECRETO PUBLIC HEALTH No. 2915 Medical Propaganda Agents. Default of Decree No. 74/74.

VISTO Expediente No. 2.020-15.253/76-2 of the Registry of State of Public Health, and attentive to Decree No. 74 of 9 January 1974, by which it was recognized as a collaborative activity of medicine and dentistry that the agents of Medical Propaganda develop; and,

CONSIDERING:

That both the recognition and the exercise of such activities is subject to the regime established by Law No. 17.132 regulating this matter.

That this legal text establishes the necessary requirements for a particular activity to be considered as a collaboration of medicine.

In order to acquire such a condition, it is necessary to collaborate with the professionals responsible for the assistance and/or rehabilitation of sick persons, or in the preservation of the health of the healthy, that is to say to act in direct contact with the patients under the direction or professional control that is established in each case.

That Article 43 of Law No. 17.132, authorizes the Executive Branch to recognize or incorporate new collaborative activities, but such power must be exercised within the limits established by the aforementioned legal text.

That the activity carried out by medical propaganda agents has a fundamentally commercial purpose, such as the promotion of the pharmaceutical industry.

That the advertising-commercial function that such agents develop cannot be assimilated to that of the auxiliaries covered by Article 42 of Law No. 17.132.

According to the information provided by the State Secretariat for Public Health and the University of Buenos Aires, the medical propaganda activity does not meet the requirements of the legal regime in force to be recognized as a collaboration of medicine and dentistry.

Therefore,

Article 1 - Refer to Decree No. 74 of 9 January 1974, which recognizes as a collaborative activity of medicine and dentistry that the agents of Medical Propaganda develop. Art. 2o... The State Secretariat for Public Health shall establish the procedure for discontinuing registrations and registrations made so far in favour of medical propaganda agents, and for the withdrawal and cancellation of the certificates and credentials granted to them.
