VISTO the "I" letter number 227.056/76, originated in the Federal Police requesting the amendment of Article 213 of the Rules of the Organic Law of the Federal Police (Decree No. 6.580/58), which was amended by Decree No. 2.933/71 (Official Gazette dated 18 July 1971), and

CONSIDERING:

That the aforementioned norm .cuya modification is intended - prescribes the requirements with which the staff of that Institution is promoted to the immediate superior degree of their respective scales, contemplating not only the scale promotions by seniority, but also the promotion by qualified seniority and by selection, and details the necessary elements that are necessary for the staff to meet, to become creditor to the immediate higher hierarchy.

That the reform to introduce does not alter in substance the already instituted, but tends to give greater formal guarantees to the dynamics regulating the Institution in such matter, by empowering the Chief of the Institution to approve and modify the order of merit discerned by the Qualifications Boards in the treatment of the promotions of the higher staff.

Therefore,

THE PRESIDENT OF THE ARGENTINA NATION

RIGHT:

Article 1 Amend article 213 of the Rules of the Organic Law of the Federal Police (Decree No. 6.580/58), as amended by Decree No. 2.933/71 (Official Gazette dated 18 July 1971), which shall read as follows:

"Article 213... The promotions shall be granted to officers within their respective scales by seniority, qualified or selection. Qualified antiquity promotion is obtained taking into account the age at grade, plus the background of conduct, professional capacity, physical abilities and higher concept, in such a way that the lack or noticeable decrease of any of them is for promotion. The selection will be carried out by assessing the moral or intellectual abilities, conduct, concept, professional skills prior to normal and perfecting courses and all other backgrounds that serve to highlight the selected as a true example among their equals. The Chief of the Federal Police shall establish to the boards the rules for the qualification of the various items mentioned above, and for the purposes specified in article 58 of the Organic Law of the Federal Police, shall fundamentally approve or modify the order of merit discerned by them in accordance with the percentages set out in Annex 18 of that legal body. The promotion by selection will be made between the officer following the last ascended by qualified seniority and the last of the same degree with the minimum time fulfilled and qualified suitable for promotion. The order of precedence in the promotion decree shall be determined taking into account the placement of officers on the scale of their degree.
