VISTO Expediente No. 283.571-I-1974 P.F., by which the Federal Police proposes the incorporation of a paragraph into article 437 of the Rules of the Organic Law of the Institution (approved by Decree No. 6.580 of 30 April 1958) and

CONSIDERING:

That the above-mentioned article gives the authorities that may provide for the instruction of the administrative court the power to decree the preventive arrest of the accused.

It is then desirable to extend that authority to the heads of the unit in which the offender is or which prevents the act, except that his decision is subject to the validation of the authority to whom it is appropriate to order the instruction of the offender.

Therefore, taking into account the fact that fox 9 is issued by the Directorate-General for Legal Affairs of the Ministry of the Interior,

THE PRESIDENT OF THE ARGENTINA NATION

RIGHT:

Article 1 ∙ Include as the third paragraph of article 437 of the Rules of the Organic Law of the Federal Police (approved by Decree No. 6.580 of 30 April 1958) the following text: "Before the initiation of the summary, when reasons of urgency make it necessary and the extremes set out in the preceding paragraphs regarding the nature and circumstance of the offence committed and elements of proof assembled, where the referendum is precluded, In such case they shall immediately communicate the measure taken to the superior who must have the instruction of the administrative summary, for the purpose of his urgent confirmation or revocation."
