DECRETO SOCIAL PREVISION No. 1,852 Special regulations for certain labour tasks.

VISTO file number 28,422 of the Registry of State for Social Security and added number 389/73 of the Secretariat of State of Merchant Marina, which promotes the establishment of a differential regime for the personnel that is carried out in the National Directorate of Port Construction and Navigatable Ways, in dredging and beacon tasks, and

CONSIDERING:

That article 66 of Decree-Law 18.037/68 (t. or. 1974) authorizes the executive branch to establish regimes that conform to age and years of services and differential contributions and contributions, in relation to the nature of the services provided in painful, risky, unhealthy or determinant tasks of old age or premature exhaustion.

That the Standing Advisory Commission established by Decree 5.006/71 for the study and analysis of requests made for the application of differential retirement regimes, produced an office in respect of the forecasting treatment to agree to the staff engaged in dredging and baling tasks.

That the result of their studies is drawn from the conclusion that these tasks are similar to those that are subject to special protection by Decree 6.730/68, as it consecrates a differential regime in respect of retirements and pensions for the staff engaged in.

Therefore,

THE PRESIDENT OF THE ARGENTINA NATION

RIGHT:

Article 1 . You will have the right to regular retirement with fifty-two (52) years of age and twenty-five (25) of services, the staff engaged in dredging and beacon tasks in a regular and direct way, in the National Directorate of Port Construction and Navigatable Ways under the State Secretariat of Marina Mercante. Art. 2o . When the tasks of those specified in the previous article have been carried out and alternates of any kind for the purposes of the requirements for the granting of regular retirement, an apportionment shall be made according to the age and service limits required for each type of task or activity. Art. 3o La The employer's contribution to the tasks referred to in article 1 will be the one in force in the common system, increased by two (2) points. Art. 4o . In the certifications of services that include all or part of the tasks of those provided for in this decree, the employer must expressly state such a circumstance. Art. 5o Las The above provisions will begin to govern from the first day of the month following the date of this decree. Art. 6th . Communicate, publish, give to the National Directorate of the Official Register and archvese.
