VISTO Article 20 of Law 19,904 empowering the Executive to create the National Industrial Promotion Council, and
CONSIDERING:
That the regional industrial promotion regimes, which as a result of the said law, should contemplate the gradual industrial decentralization, together with the harmonious development of the interior of the country, and further enhance the existing legislation for different regions in the field of industrial promotion.
That the country is subdivided into eight development regions, in accordance with Law 16,964 and its regulatory decrees.
It is desirable that the tasks of studying and evaluating the industrial development needs of the different geographical areas be undertaken at a first stage, directly in each of the development regions.
That obviously and because of the philosophy of Law No. 19,904 should be excluded from such tasks to the metropolitan region.
To this end it is advisable to establish Regional Councils and on the basis of its members to create the National Industrial Promotion Council who will be responsible for advising the Ministry of Industry and Mining, mainly regarding the graduation of benefits and incentives to apply in the different geographical areas and the determination of the economically most convenient industries for each region.
Therefore,
THE PRESIDENT OF THE
RIGHT:
Article 1 . Créase el Consejo Nacional de Promoción Industrial (CONAPI), que será preside por el Ministro de Industria y Minería quien podrá delegar sus funciones en el Undersecretary de Industria. Art. 2° El The National Industrial Promotion Council will be formed on the basis of seven regional Industrial Promotion Councillors, corresponding to the following development regions: Patagonia Development Region:(Provinces of Chubut and Santa Cruz and National Territory of Tierra del Fuego, Antarctica and South Atlantic Islands).
Comahue Development Region:(Provinces of Río Negro, Neuquén, La Pampa and the parties of the province of Buenos Aires that are members of the Region, in accordance with the provisions of Decrees No. 1.907/67 and 7.592/69).
Development Region Cuyo:(Provinces of Mendoza and San Juan).
Centre Development Region:(Provinces of San Luis, Córdoba and La Rioja).
Northwest Development Region:(Provinces of Catamarca, Salta, Jujuy, Tucumán and Santiago del Estero).
Northwest Development Region:(Provinces of Chaco, Formosa, Misiones y Corrientes and the departments of the province of Santa Fe members of the Region, in accordance with the provisions of Decrees 1.907/67 and 7.592/69).
Pampeano Development Region:(Provincia de Entre Ríos, the province of Santa Fe with the exception of the departments included in the Northeast Region and the province of Buenos Aires, with the exception of the parties included in the Comahue Region and in the Metropolitan Area Region).
Art. 3rd Los Regional Industrial Promotion Councils will be integrated as follows:(a) One representative for each of the provinces or national territory, partial or fully included in the respective region;
(b) The Director of the corresponding Regional Office of the Under-Secretary for Development;
(c) A representative of the Ministry of Industry and Mining.
The representatives referred to in subparagraph (a) shall be appointed by the respective local government.
Art. 4° Los The Regional Councils will meet at the headquarters of the respective Regional Office of the Undersecretariat for Development and will be coordinated by the Director of that office. Art. 5° . Within ten (10) days of the date of the sanction of this Decree the local government shall communicate to the Ministry of Industry and Mining the representatives referred to in article 3 (a). Within five (5) immediate days thereafter, the Ministry will report the composition of each Regional Council and set the date of its first meeting. Art. 6° 6 The National Industrial Promotion Council will be integrated as follows:(a) One representative for each of the provinces or national territory;
(b) Two representatives of the Government Planning and Action Secretariat;
(c) A representative of the National Development Bank;
(d) Two representatives from the Ministry of Industry and Mining.
The representatives of subparagraph (a) shall be appointed to the Regional Councils, except for the cases of those provinces that are part of two Regional Councils, which shall designate a single representative to CONAPI, choosing it between their two regional delegates. This designation shall be made within ten (10) days of the date of sanction of this decree.
The representatives of subparagraphs (b) and (c) shall be appointed by the respective agencies within fifteen (15) days of the date of the sanction of the present decree, having in the first case correspond one to the Under-Secretary for Development and the other to the Under-Secretary for Security.
All members of CONAPI will have their respective alternates.
Art. 7° La The Secretariat of the National Industrial Promotion Council will be exercised by the official designated by the Ministry of Industry and Mining, with a minimum hierarchy equivalent to that of the National Director. Art. 8° La The constitutive meeting of the CONAPI shall be held within sixty (60) days of the date of the sanction of this Decree. It shall meet at least once every four (4) months and be convened by its President. Any Regional Council, through its coordinator, may request the Ministry of Industry and Mining to convene CONAPI with specification of the topics to be addressed.CONAPI will be based in the Ministry of Industry and Mining.
Art. 9° Los The Regional Councils shall propose to CONAPI, as provided for in Act No. 19.904, the list of industries most suitable for the region with their respective location.The proposal should be based on, inter alia, the following guidelines:
(a) Taking advantage of local raw materials;
(b) Regional market, domestic market and external market;
(c) Availability of human resources;
(d) Infrastructure available.
The Regional Councils shall make their proposal within thirty (30) days of the date of their first meeting.
Art. 10. After the task referred to in the previous article, the Regional Councils shall meet at least once every three (3) months for which they shall be convened by the Coordinator. Such meetings should assess and analyse the progress of promotion for the respective region, bringing its findings to the Ministry of Industry and Mining.Without prejudice, they may be convened for specific issues by the Ministry of Industry and Mining or by the National Industrial Promotion Council. In all cases, the Ministry of Industry and Mining will request the call to the Coordinator, with specification of the topics or consider.
Art. 11. . Within forty-five (45) days of the date of sanction of this decree, the Ministry of Industry and Mining shall issue the operating regulations of CONAPI. Art. 12. : Will be the functions of the National Industrial Promotion Council:(a) Analyse, evaluate and support the findings of the Regional Councils, taking into account the guidelines set by Act No. 19,904 and advise the Ministry of Industry and Mining on the measures to be taken.
(b) He advises the Ministry of Industry and Mining in the classification of the economically more convenient industries for each geographical area and the consequent graduation of the benefits to be applied in each of them.
(c) To give an opinion on all issues relating to industrial promotion submitted to it by the Ministry of Industry and Mining.
Art. 13. El The President of CONAPI may invite representatives of public bodies to participate in the meetings that it is appropriate to consult for the treatment of specific topics. Art. 14. . Communicate, publish, give to the National Directorate of the Official Register and archvese.LANUSSE.
