VISTO the situation of internal shock produced at the national level and considering that terrorist action has increased to the point of jeopardizing the internal security and the process of institutional standardization to which the Government of the Nation is engaged, which is reported by the Minister of the Interior at a Cabinet meeting, as proposed by the Minister of Defence and the Board of Commanders in Chief and attentive to the provisions of Article 43 of Law No. 16.970 and Decree No. 4067

THE PRESIDENT OF THE ARGENTINA NATION

RIGHT:

Article 1 de Declárase Emergency zone from 05:00 hours on May 1, 1973 to the area corresponding to the Province of Santa Fe, which will be called "Santa Fe Emergency Zone". Art. 2o . Name the commander of the emergency zone "Santa Fe" to the Commander of the IIdo. Army Corps "General Lieutenant Juan Carlos Sánchez" General of Division D. Elbio L. Anaya. Art. 3o las Commending the Commander of the Emergency Zone the following forces:

(a) Military: Forces and means that currently have their seat in the Emergency Zone .except cadets and seekers. and others that eventually make available the commanders in Chief of Forces at the request of the Commander of the Emergency Zone.

(b) Argentine Naval Prefecture: those with seats in the Emergency Zone and those determined by the Commander-in-Chief of the Navy.

(c) National Gendarmerie: those with seats in the Emergency Zone and those established by the Commander-in-Chief of the Army.

(d) From the Federal Police: the authority and forces that have seats in the Emergency Zone and those determined by the Ministry of the Interior.

(e) From the Provincial Police: The Head, the forces that have seats in the Emergency Zone and those that the Government of the Province determines in its reinforcement.

Art. 4o . From the time indicated in Article 1 the agencies and divisions of the national, provincial, municipal, auto-archic entities and State enterprises, existing in the Emergency Zone, although they will retain for the conduct of their respective regular missions, their organic-functional relationship, will be subordinated to the Commander of the Area in the performance of the orders and tasks that he or she gives to them and assigns to them in the exercise of their duties.

It will have absolute priority over any other activity the fulfillment . by such agencies and divisions las of the orders and tasks given by the commander of the zone and the origin or legitimacy of them cannot be questioned in any case during the validity of the Zone of Emergency.

Art. 5o . The Governor of the Province and its Ministers, although excluded from the regime established in the previous Article, shall not interfere, alter or nurture the orders and tasks given or assigned by the commander of the Emergency Zone under the said Article. Art. 6th . Make the Commander of the Emergency Zone dictate bands, which in each case may impose the penalties set out in Article 528 of the Code of Military Justice (Act No. 14.029). Art. 7o . The special war councils established in Book III, Section I of the Code of Military Justice, which will be known in the trial of the crimes that the bands foresee and repress, will be established in the "Santa Fe" Emergency Zone.

Please inform the Commander of the Emergency Zone to operationalize the Special War Councils, composed of members of the three Armed Forces, which are necessary as the number of cases so requires, as well as to designate its components.

Art. 8o . The trial by the Military Justice referred to in the previous Article shall be carried out by the Special War Councils provided for in Article 45 of the Code of Military Justice in accordance with the organization established in Articles 33 et seq. and by the summary procedure provided for in Articles 482 to 501 and consistent with the same legal body.

In each case the Commander will determine the War Council to intervene.

Art. 9th ). Please provide the Commander of the Emergency Zone to provide for the requisition of goods and services in the affected area under Article 36 of Act No. 16.970 (National Defence Act). Art. 10. . Please provide the Commander of the Emergency Zone with the provision for the case under Act No. 17.192 concerning the Civil Defence Service. Art. 11. . As prescribed in Article 40 of the regulation of Law No. 16,970, the Commander of the Santa Fe Emergency Zone will depend on the President of the Nation through the Board of Commanders in Chief. Art. 12. . The expenses that demand compliance with this Decree will be met with general income. Art. 13. . This Decree will be endorsed by the Ministers of the Interior, of National Defense of Justice, of Finance and Finance, of Foreign Affairs and Worship, of Agriculture and Livestock, of Industry and Mining, of Trade, of Labour, of Social Welfare and of Public Works and Services and by the Board of Commanders in Chief. Art. 14. This Decree shall be publicized by all means of oral, written and television broadcasting. Art. 15. . Communicate, publish, give to the General Directorate of the Official Register and archvese.
