Provisions relating to the export of works of art and others.

VISTO the regime concerning the export of works of art and others that integrate the heritage of the Nation and,

CONSIDERING:

That Act No. 12.665 and Decree-Law 9.002/63 adopted provisions for the preservation of cultural heritage in certain respects, including for certain goods the need for prior authorization to enable their export;

However, the practice advises to submit to a thorough study the regime and control of export of works of art and cultural interest, in order to avoid operations that may eventually affect this artistic and cultural heritage of the Nation, which must be preserved;

In the meantime, it is considered prudent to have the suspension of this kind of exports, with a precautionary and extreme urgency due to the state of emergency in the matter.

That in terms of the works of Argentine authors it is considered appropriate to continue to facilitate their departure from the country, in order not to prevent the spread abroad of our values to be appreciated in the different countries by making their qualities known, but to condition these circumstances, in addition to the previous permission of the Ministry of Culture and Education, so that this exception reviews the necessary selective character that also protects the cultural heritage:

That these measures are consistent with the Convention adopted in Paris on 14 November 1970 by the General Conference of UNESCO, adopted by the so-called Law 19,943, and which is currently in force for our country;

Therefore,

The CHAIRMAN OF THE HONORABLE CAMARA OF DIPUTADOS DE LA NATION IN EXERCISE OF THE EXECUTIVE POWER

RIGHT:

Article 1— Eliminate export rights from the following positions of the Export Nomenclature:

99.01.00.00 Paintings, paintings and drawings made entirely by hand, excluding industrial drawings from position 49.06 and hand-crafted articles.

99.02.00.00 Original prints, prints and lithographs.

99.03.00.00 Original works of the estuary and sculptural art of any matter.

99.05.00.00 Collections and specimens for collections of zoology, botany, mineralogy and anatomy; objects for collections that present an archaeological, palentological, ethnographic and numismatic historical interest.

Art. 2°- Enter the Export Nomenclature the following position: 99.01.01.00 Originals.

Art. 3° - Incorporate the following positions to the Export Nomenclature, with export rights as follows:

99.01.01.1 National author, with export license issued by the Ministry of Culture and Education.... 0%

Art. 4° — Replace the export of the goods covered in the following export Nomenclature positions:

99.01.09 The rest.

99.05.02.00 Objects for collections that present a historical, archaeological, paleontological, ethnographic and numismatic interest.

99.06.00.00 Antiquity objects greater than a century.

Art. 5°—Except as provided in the preceding article:

(a) The re-export of the goods of that nature led by passengers in the category of tourists, temporary or transit, conditioned that in the opportunity of their previous introduction to the country, they declare them before the customs authority;

(b) Temporary exports with authorization issued by the Ministry of Culture and Education;

(c) The final re-export of goods in a timely manner imported but without a definitive character, for being subject to a suspensive customs regime:

(d) Property owned by foreign diplomatic representations and officials who have been declared to customs on their entry into the country;

(e) Property sent by the Ministry of Foreign Affairs and Worship or other official agencies for the use of permanent representation abroad.

Art. 6°—The export suspensions referred to in Article 4 extend to goods that constitute baggage and travel incidents of passengers and particular shipments of the same nature, with the exceptions of the previous article.

Art. 7° — The National Customs Administration shall take appropriate measures to ensure proper compliance with the provisions of this decree.

Art. 8° — E! Ministry of Culture and Education shall issue regulations relating to the procedure and granting of licences and authorizations referred to in articles 3° and 5° clel this decree. In addition, the Ministry, within the 90th (90) days, will carry out a comprehensive study on measures suitable for the protection of the artistic and cultural heritage of the Nation, with the proposals of the corresponding measures to be taken.

Art. 9° — This decree shall enter into force from the date of its publication in the Official Gazette.
