DECRETO SOCIAL PREVISION No. 710 Retirementary regime for staff serving in a railway branch.

Article 64 of Decree-Law 18.037/68 and

CONSIDERING:

That the above-mentioned legal rule authorizes the Executive to establish regimes that meet age and years of service and contribution and differential contributions, in relation to the nature of services rendered in painful, risky, unhealthy or determinant tasks of old age or premature exhaustion;

That the Standing Advisory Commission established by Decree 5.006/71 for the study and analysis of the requests made for the implementation of differential retirement regimes produced dispatch regarding the consequences on the individual of the continuous provision of tasks in high-rise areas;

That the result of their studies is drawn to the conclusion that the tasks performed by the personnel of the Argentine Railway Company in the branch located between Puerta Tastil and Socompa, in the Province of Salta, meet the conditions mentioned above, and can produce a physical deterioration capable of transforming into early ageing;

Therefore,

THE PRESIDENT OF THE ARGENTINA NATION

RIGHT:

Article 1 . They will have the right to regular retirement with 50 years of age and 25 years of service, the staff employed by the Argentine Railway Company in the railway branch that works between the localities of Puerta Tastil and Socompa, in the province of Salta.

Art. 2o . When tasks have been carried out in the area referred to and alternately other than those in regions other than the one mentioned in the previous article, for the purpose of determining the requirements for the granting of regular retirement, an apportionment shall be made according to the age and service limits required for each kind of task or activity.

Art. 3o El The contribution corresponding to the staff referred to in the present decree and the employer's contribution will be those that govern in the common system increased both in three (3) points.

Art. 4o . In the certifications of services that include in whole or in part tasks of those provided for in this decree, the employer must expressly state such a circumstance.

Art. 5o Las The above provisions will begin to govern from the first day of the month following the date of this decree.

Art. 6th El This decree will be endorsed by the Minister of Social Welfare.

Art. 7o . Communicate, publish, give to the National Directorate of the Official Register and archvese.
