VISTO the provisions of Act No. 17.818; and

CONSIDERING:

Article 13 (in fine) establishes the obligation on the part of the national health authority to verify the quantity and quality of the narcotics obtained by the establishments empowered to produce them.

That it is necessary to rule the procedure to be followed in order to meet those requirements.

That the proposal responds to the Nros National Policies. 39, 40 and 126,

RIGHT:

Article 1 - The Ministry of Social Welfare, through the National Institute of Pharmacology and Bromatology, and with the intervention of the Department of Pharmaceutical and Food Industries Control, shall intervene any drug proceeding developed in the establishments authorized for such purposes, regardless of the origin of the raw material with which the narcotics are produced.

Art. 2o - The National Institute of Pharmacology and Bromatology will proceed to analyse these items within 15 working days, counted from the time the processing establishment communicates their availability for the purposes of the analysis. Such an analysis shall have an official character.

Art. 3o - At 15 working days of the communication, if the establishment had not been notified that by the results of the analysis the departure must remain involved, it may be considered unintervented for the purposes of its marketing. If subsequent checks were to determine that such a liberated departure did not meet the required quality and purity conditions, the responsibility would be vested in the development and its technical director, who would be liable for the sanctions provided for in Chapter VIII of Law 17.818.
