ARMED AND SECURITY FORCES DECRECT N° 6.918 Federal Police. The Rules of the Organic Law are partially amended. Bs. As., 6/10/72
VISTO Expediente No. 199.664/I/72, by which the Federal Police encourages the modification of the articles. 215 and 216 of the regulation of the organic law of that institution approved by Decree No. 6580/1958, and
Considering:
That the supplementary reports provided by art. 215 of the regulation of the Organic Law of the Federal Police allow to obtain valuable background for the qualification of the senior staff of the division, and it is therefore considered necessary to give it greater scope for the qualifiers and qualifications, also establishing a system that simplifies the work to be accomplished;
That regarding the reform promoted in the composition of the Qualifications Boards for the Senior Staff of the Federal Police -art. 216 of the precited regulatory text implies a conception that responds broadly to the principles that led to its creation, in accordance with the experiences gathered;
That within the grades to be described by the Higher Qualifications Board, the Commissioner is included, because of the transcendent fact that it constitutes the qualification and selection of those who will have access to the category of senior officers, which due to their organizational and institutional implications, must be the exclusive matter of the highest police hierarchies, in this case, the Commissioners General;
That the organic adjustment indicates the desirability of including among the steps qualified by the Qualifications Board No. 1 to the level of inspector officer, formerly in the area of competence of the Qualifications Board No. 2.
That the act of the qualification implies a transcendent consequence for the police career, therefore it was considered appropriate to dispense with the presence of the officers of the degree of sub-commissionary, in the qualifier, to maintain the organic guidelines observed in the remaining boards;
This is consistent with national policies 127 and 129 (Decree No. 46 of 17/6/1970);
For this reason, and attentively, the General Directorate of Legal Affairs of the Ministry of the Interior;
THE PRESIDENT OF THE ARGENTINA NATION
RIGHT:
Article 1- Replace the text of article 215 of the regulation of the Organic Law of the Federal Police, approved by Decree No. 6580/1958, with the following:
"Article 215.- Senior officers and Chief Officers shall submit supplementary reports on all senior staff of lower ranks to their own, only in relation to their unfavourable background and who have not been subject to any disciplinary procedure. These reports are intended to fill information on the personal and professional conditions of senior staff, should be held by the respective Qualifications Boards at the time of their first meeting. "
Art. 2°- Replace the text of article 216 of the regulation of the Organic Law of the Federal Police, approved by Decree No. 6580/1958, with the following:
"Article 216.- The qualification of officers of the different grades and scales for promotions, producing vacancies and remaining in service, will be discerned by the respective Qualifications Boards. These boards shall be constituted in accordance with the following order:
1. Higher Qualifications Board: Deputy President of the Federal Police. It will be composed of all Commissioners General in effective service and the Chief of the Federal Security Superintendency. He shall qualify the officials of the grades of Chief Commissioner, Inspector and Commissioner, and shall take charge of the requests for reconsideration arising under qualifications discerned by lower boards.
2. Qualifications Board No. 1: President: One (1) General Commissioner of the Security Scale appointed by the Chief Command. It shall be composed of a major commissar for each of the superintendents and a senior officer by the General Staff and shall qualify the staff of the grades of sub-commissioned, chief officer and inspectorate. When firefighters and communications personnel are qualified, a senior officer will be included.
3. Qualifications Board No. 2: President: One (1) General Commissioner of the Security Scale appointed by the Chief Command. It shall be composed of officers of the ranks of inspector or commissar. They will represent each of the superintendents and the General Staff and qualify the officers of the ranks of sub-inspector, assistant and sub-helpant. When firefighters and communications personnel are qualified, a senior officer or deputy commander of these scalers will be incorporated.
