VISTO the Regime for the Accumulation of Charges, Functions and/or Passivities approved by Decree No. 8.566/61, and

CONSIDERING:

That the provisions of that order assigned to the then General Directorate of the Civil Service of the Nation, the centralization, control and interpretation of the rules on the matter, the competence assumed by the General Secretariat of the Presidency of the Nation when the dissolution of that agency was operated.

That the experience gained through the time elapsed since the implementation of the Regime makes it advisable to decentralize its application, assigning responsibilities to the various ministerial jurisdictions and agencies within its scope and maintaining only one oversight, via sampling audit.

That in such a way a more effective countermeasure of compliance with the rules on incompatibility, impossible to carry out massively, as a result of the system applied so far, as the amount of controls to be carried out dilutes the efficiency of the system.

The updating of the data registration system provided for by Decree No. 6728/68 is necessary.

Therefore,

THE PRESIDENT OF THE ARGENTINA NATION

RIGHT:

Article 1 - Delete in the "Regime on the Accumulation of Charges, Functions and/or Passivities for the National Civil Service", approved by Decree No. 8.566/61, and in the regulations amending or supplementing it, all provisions that assign competence to the former Directorate-General of the Civil Service of the Nation to intervene in the centralization, control or interpretation of the rules on the matter, and in the reception of the affidavits made by the State agents.

Art. 2° - The copy of the affidavits referred to in article 14 of the Regime approved by Decree No. 8.566/61, once intervened by the Office of the Public Prosecutor or Audit of the Court of Accounts of the Nation, shall be returned to the administrative service corresponding to the purposes provided for in article 16 of that order, as amended by Decree No. 728/63.

Art. 3rd The General Secretariat of the Presidency of the Nation, through the Directorate-General of Administrative Organization, will implement a sampling audit system, to verify in each of the agencies included in the Regime of the accumulation of posts, functions and/or passivities, compliance with the rules and procedures established therein.

In the event of violations of such violations, it shall proceed to bring them to the attention of the superior authority of the relevant jurisdiction or agency, in order that they take the relevant measures, of which the General Secretariat of the Presidency of the Nation should be informed immediately.

Art. 4° - The General Secretariat of the Presidency of the Nation shall return to the respective ministries and agencies the affidavits of the accumulation of posts, functions and/or passivities that operate in its power, and those from the former Directorate General of the Civil Service of the Nation.

Art. 5° - Include the Registry of Civil Staff of the National Civil Service (Decree No. 6728/68) to the staff of the State and the Municipality of the City of Buenos Aires.

Art. 6° - Form SCD - RPAP No. 3, which is attached as an annex to the present decree, shall be filled by the staff of the State Companies and the Municipality of the City of Buenos Aires, at the time of receiving their assets for the month of November 1972, and referred to the General Secretariat of the Presidency of the Nation by 20 December 1972.

Art. 7° - The Central Administration, Decentralized Agencies, Special Accounts, Official Banks and Social Works shall complete the new form on the dates to be determined by the General Secretariat of the Presidency of the Nation.

Art. 8° - Please provide the General Secretariat of the Presidency of the Nation with the necessary instructions for the better implementation of these provisions.

Art. 9° - Communicate, publish, give yourself to the National Directorate of the Official Register and Archdiocese.
