ARMED FORCES AND SECURITY Federal Police. Partially amend the Organic Law. DECEMBER No. 2.465

VISTO Expediente M.I. 113.650/70 by which the Federal Police requests the amendment of the Rules of the Organic Law of that Institution, approved by Decree No. 6.580/58, and

CONSIDERING:

That the regulatory body has not yet provided for assignments for " burial fees" and "luto fees", as an institutional contribution to extraordinary erogations motivated by the death of police personnel;

It is appropriate to save this omission as a means of assistance to the police ' s awards, and to take care of the institution ' s staff, the prestige of the institution and the investigation corresponding to the degree of the deceased;

For this purpose, it is necessary to modify Chapter XVIII, Book II, of the aforementioned Rules, introducing the corresponding compensations with a regime similar to that already governing other forces;

This reform is based on National Policy No. 45 (Decree 46 of 17/6/70, B.O. of 29/6/70),

Therefore,

THE PRESIDENT OF THE ARGENTINA NATION

RIGHT:

Article 1 ∙ Add as article 332 bis of the Rules of the Organic Law of the Federal Police (Decree 6580/58) the following text:

"Article 332 bis . Police personnel's awards shall be entitled to compensation allowances for funeral expenses and compensation for mourning expenses, in accordance with the following detail:

"I . Consider "Buy for burial expenses" the allocation that is agreed to as a contribution to meet the costs that demand veil and sepellium of police personnel in activity or in retirement called and agents incorporated under the Decree No. 18,231/50 deceased, in amounts set out in Annex I and as prescribed below:

"a) A member of the family, agency or person who has taken charge of the wake or sepellium shall be made and it shall be proved to have borne or committed the funeral expenses of the extinct, in the latter case, to certify that circumstance by police authority.

"b) The sum to be paid will be the one that has actually been invested or contracted within the limits set out in the scale of Annex I.

If the sum of the " burial fee" that is demanded is less than the one that corresponds to liquidate, the difference will increase the compensation for "luto fee" established in paragraph II of this article, and will be paid to the awards entitled to a pension, in the exclusive order determined in the same article.

"c) When the death occurs "in and by act of service" and the State takes charge of the burial of the extinct, the amount set in the scale for such expenses may be increased to the total cost of the sepellium when it is circumstantial.

"d) When family members or other authorized persons are taken over and the funeral service is undermining the prestige of the Federal Police or the inauguration of the deceased, the circumstances will be observed to those concerned by letting them know that this will lead to the loss of the right to the "Contribution for Burial Expenses". If the reason for the observation is not corrected, the Superintendency of Administration will be informed for the purposes indicated.

(e) In cases where the remains of the deceased are infused in a place far from that where the wake was made and that by such circumstance there would be a need to transfer the body and perform a second wake, the amount to be liquidated according to the application of the scale of Annex I, can be raised up to 40% (account per cent) more.

The resulting amounts will be the maximum amount to be compromised and their investment will be regulated within the economic sense of good administration, in accordance with the degree of the deceased.

"II . Consider "Compensation for mourning expenses" that is granted to the awards entitled to pension of the police personnel in activity or in retirement called and agents incorporated under Decree No. 18,231/50 deceased, in the amounts set out in Annex II.

This concept includes:

"a) For awards entitled to pension of staff of Officers, Officers and Effective Agents: one (1) month of remuneration which in all concepts receives the generality of staff in effective service, of the same degree as the deceased.

"b) For the awards entitled to pension of the staff of agents incorporated under Decree No. 18,231/50, one (1) month of remuneration which in all concepts receives the generality of the staff with the degree of effective agent in activity.

"c) For the awards entitled to pension of the staff of Cadets alumni, one (1) month of remuneration that in all concepts receives the generality of the staff with the grade of Assistant Officer in activity, effective service.

"The compensation for luto expenses shall be given to awards entitled to pension, in the following exclusive order:

(1) To the wife, in concurrence with the children.

2) To children, there is no wife.

(3) To the wife, in concurrence with the parents, there are no children.

(4) To the wife, there are no children or parents.

5) To parents, there is no wife or children.

6) To the sisters and/or brothers, there is no wife, children or parents."

Art. 2o The amount required to meet the costs required to comply with the provisions, shall be included in the provisions assigned to the Federal Police on an annual basis in accordance with the budget laws.
