Decree No. 9.544/1967
NAFTA, KEROSONE, GAS OIL, DIESEL OIL and FUEL OIL. - New official prices.

Buenos Aires, December 28, 1967.

VISTO the provisions of Act No. 17.597 and

CONSIDERING:

That it is necessary to adjust the prices of fuels for the purposes, not only to cover the increase in costs that has occurred in the fifteen months since the prices were set by Decree 1.850/66, but particularly to constitute a tax vehicle as is the case in most parts of the world and to obtain the necessary resources for the intensification of road and energy public works;

That according to the experience and the studies carried out, it is advisable that such an increase be concentrated in the prices of naphthas, so as to reduce the impact of that measure within the possible time in the increase in the production costs of other activities in the country;

That the proposed increases bring the prices of naphthas to levels that remain low compared to those of most industrial countries in the world, while the relations with the prices of other fuels remain within the existing limits in the Western world;

That the retention values should also be adjusted in such a way as to enable oil companies to cover the greatest costs that have occurred in their exports;

That the recent crisis of the Meido Oriente has caused a significant rise in the sea freights of tank vessel, which does not allow companies to resarcise through the implementation of the Decree No. 1,850/66 of its highest costs caused by the import of Kurdish oil and/or derivatives, essential for the normal supply of the country;

That it is appropriate to solve the outstanding problem of the price of the crude oil of the Neuquén and Rio Negro mixture, which led between January 7 and September 19, 1966, in order to adjust it to the technical characteristics of that product:

That is why and attentive to the proposals of the State Secretariat for Energy and Mining;

The President of the Argentine Nation,

Decrete:

Article 1 - Please note from the zero hour (0) of 29 December 1937 the official prices of liquid petroleum fuel derivatives, as follows:

Art. 2° - Mandify the special prices of sale for fuels used in the consumption of electrical usins of public services and railways set out in Article 2° of Decree No. 1.850/66.

Art. 3° - From the zero hour (0) on December 29, 1937, the amounts of the levies to the liquid fuels derived from the national oil referred to in article 1 of Act No. 17.597, in the following values:

Art. 4° - The levies to imported and/or imported liquid fuels from the industrialization of imported oil are equal in each period to the differences between official sales prices and the retentions authorized by Decrees 1.850/65 and the present.

Art. 5° - Taxpayers responsible for the levies of Law No. 17.597 shall retain the official price for sales in the domestic market of liquid fuels derived from national oil from the day of 1 January 1938, and of liquid fuels imported or derived from imported oil, from 1 July 1957, the amounts indicated below are:

The retention values set out in this article include the incidence of the levy set by Law No. 17.574 to 8% and the readjustment of bonuses to resellers in a whole in accordance with the provisions of Article 1 of the Resolution of the Secretariat of State of Energy and Fuels No. 6/65 of 19 February 1985.

Art. 6°- The retentions set out in Article 8 for the liquid fuels obtained in the industrialization of national oil have been determined on the basis of the following FOB prices for the different types of oil of Fiscal Petroliferous Authority, in dry-seco condition

Art. 7° - The prices of the national oils set out in Article 8° will be adjusted by variation of gravity at the rate of forty pesos national currency (m$n 40.-) for each cubic meter of oil in more or less for each entire API degree of difference above or below the basic gravity established in that article.

Art. 8°- The retentions set out in Article 5 for imported and/or imported by-products of the industrialization of imported oil are adjusted by variation of the import prices of petroleum derivatives taking the average monthly FOB contributions in the Caribbean area (Curacao) of the Platt's Oil Gram, comparing them with the corresponding values of the following table that served as the basis for the determination of the retentions set out herein:

Art. 9° - The retention values set in Article 5° for the imported and/or imported liquid fuel by-products from the industrialization of the imported oil will be adjusted by the variation of the international marine freights that govern for each month period, according to AFRA (Average Freight Rate Assestment) for the corresponding kind of ship-tank and the following ports of load of each port of Buenos Aires,

The State Secretariat for Energy and Mining may designate the representative ports of cargo of other shipping areas.

Article 10 - Oil companies shall readjust the derivatives from the industrialization of imported oil and/or directly imported, in accordance with the detail indicated in the annexed plank that is an integral part of the present decree, the variations in the emerging costs of such costs and/or freight or, i.e., tax recognized Law No. 17.574, Maritime insurance, bank charges, consular duties, customs duties, customs duties, customs duties Law No. 17.574 for finished by-products shall be excluded from the adjustment.

Art 11 - The retention values set for the imported and/or petroleum-derived product will be adjusted by the changes in the exchange market, between the US dollar and the national currency weight. The calculation will take into account that the basic values taken in Article 5 have been determined for that product considering the US dollar equal to three hundred and fifty pesos national currency (m$Sn 350). The adjustment will take the arithmetic sales average of the average monthly quotes of the Banco de la Nación Argentina, applying it to the sales volume of the same period.

Article 12 - With effect from 1 July 1967 and as long as the circumstances of exception that motivate the regime approved by this decree remain, they shall govern the following rules.
(a) For the purposes of the calculation of the retentions of Diesel and Fuel Oil, for sales for the consumption of electrical usins of public services and railways, the products supplied with this destination shall be considered to be of exclusively national origin:
(b) Except for the payment of statistical rights set by Decree No. 6.123/61 to imports of oil and/or its derivatives.

Art. 13 - The adjustments referred to in Articles 8°, 9°, 10 and 11 shall be submitted by producer and/or importing companies on a monthly basis to the Secretariat of State of Energy and Mining, within 20 days of the end of each month, reviewing the character of affidavit. The above-mentioned Secretariat shall adopt or rectify them within 30 days of their submission. Following that term without resolution, the adjustments submitted will be approved.

Article 14 - The levy established by Law 17.574 for the financing of the works of the Chocón-Cerros Colorados Complex shall be liquidated and deposited in accordance with Resolution No. 1/67 of the Secretariat of State for Energy and Mining.

Art. 15 - Look at three thousand nine hundred fifty pesos national currency (m$n 3.950) the cubic meter, the FOB price of the crude oil mezcal Neuquén and Rio Negro placed at the terminal of the pipeline Challacó - Puerto Rosales, with a content of up to two per thousand (2 0/00) of water and sediment, during the period between 7 January 1966 and 19 of the basic gravity of the

Art. 16 - Please note that the sale of mixtures of liquid fuels derived from oil is governed by official prices of sale, taxes and retentions, due to the perceptions that correspond to each product that has participated in its composition.

Art. 17 - From hour zero (0) on January 1, 1968, Aguarrás and similar products m$n 9 per litre.

Art. 18 - Fiscal Petroliferous deposits will continue to sell natural gas and liquid gas to State Gas at the price of applying the percentages set by Decree 2.785/60 to the retention values established by Decree 1.850/66.

Art. 19 - The Secretariat of State for Energy and Mining shall be responsible for the implementation of the present decree excluding those aspects by the General Impositive Directorate, as long as the Law No. 11.603 (t. 1960) and its amendments are applied.

Art. 20 - The present decree will be endorsed by the Minister of Economy and Labour and signed by the Secretaries of State of Energy and Mining of Public Works and of Finance.

Art. 21 - Communicate, publish, give to the National Directorate of the Official Register and archvese.
