It will undertake studies to establish a system that recognizes the participation of SEGBA users in the capitalization of that company.

VISTO the tariff table for the Services Company of the Greater Buenos Aires (SEGBA) approved by the State Secretariat for Energy and Fuels, by Resolution No. 133/64 of 31 December 1964, to govern during 1965, and

CONSIDERING:

That the rate table has been set in accordance with the procedure and calculation bases set out in the concession contract signed between the Government of the Nation and SEGBA on 1 February 1962;

That the single shareholder of SEGBA is currently the only shareholder and therefore the only recipient of the benefits resulting from the development of its activities, there is no inconvenience in the continued application of the provisions of the concession contract, until an organic and rational solution of the activities of the state electric companies in general, and the provision of the public electricity service in Gran Buenos Aires, in particular;

That, regardless, there are judgement elements that allow to ensure that the average rate charged to users covers not only the costs of public service, but also includes a certain capitalization intended for part of the works required to standardize such service, in the form of ensuring its efficiency and safety;

That such capitalization arises from the net profit that the concession contract establishes in favour of SEGBA, which is calculated by eight percent of the value of the depreciated asset recorded in dollars, which means a permanent revaluation of the investments made annually;

That it is fair to recognize users the contribution they make for such capitalization;

That is why and what is proposed by the State Secretariat for Energy and Fuel,

Decrete:

Article 1. - To instruct the Secretariat of State of Energy and Fuels to undertake the necessary studies to establish a system that will give effect to the recognition of the participation that the users of the service have in the capitalization of the Company Electrical Services of the Great Buenos Aires (SEGBA), through their rates.

Art. 2°. - This decree will be endorsed by the Minister Secretary in the Department of Economics and signed by the Secretaries of State of Energy and Fuel and Finance.

Art. 3. - Communicate, publish, give to the General Directorate of the Official Gazette and Prints and archvese.
