DECRETO No. 1.640 . Bs. As., 23/12/63

VISTO Records 415.724/63 and 432.760/63 of the Secretariat of State of Energy and Fuel, and

CONSIDERING:

That the Federal Council for Electrical Energy integrates the advisory administration of the National State, in accordance with the purposes to which they must comply under article 24 of Act No. 15,336;

That article 27 of the Act further emphasizes this characteristic, by ordering that they shall act as technical and administrative bodies of the Federal Council for Electrical Energy, the units to be determined by the Secretariat of State of Energy and Fuel;

That when Decrees Nos. 9.128/63 and 9.129/63, delegate to the Federal Council on Electrical Energy the powers of administration, alter the spirit and the provisions of the law that the body created, and therefore violate the provisions of article 86, paragraph 2, of the National Constitution;

That, without prejudice to the foregoing, it is advisable to adopt legal measures amending regimes that carried a long and quiet application, without undertaking all the necessary previous studies, with so much greater reason that at the time of the decrees number 9.128/63 and 9.129/63, there were only two days left for the establishment of the constitutional government;

For all this and attentive to the proposals of the Secretary of State for Energy and Fuels.

Decrete:

Article 1 - The Decrees number 9.128 and 9,129, both dated October 10, 1963.

Article 2 - Article 19 of Decree No. 2.073/61, which regulates Act No. 15,336, is fully in force.

Article 3 - This decree shall be endorsed by the Minister Secretary in the Department of Economics and signed by the Secretary of State for Energy and Fuels.

Art. 4o ­ Communicate, publish, give to the General Directorate of the Official Gazette and Prints and archvese.
