DECRETO N° 1.675

Rule the Law 15,928

VISTO this file No. 35.220/60 and Law No. 15.928, which refers to the prohibition of the sale and use of inappropriate paintings for the marking of sheep, wool and wool containers, and

CONSIDERING:

That it is necessary to regulate this law, for the purpose of the best compliance with the provisions contained therein;

That there is a lot of wool containers marked with black piunture, which is currently used in the lanero trade, whose immediate elimination would bring enormous damages for their high cost, and therefore it would be appropriate to authorize the iusotion of the same until their gradual and rational replacement;

Therefore, and the proposal of the Secretary of State for Agriculture and Livestock,

The President of the Argentine Nation, Solve:

Article 1- From the date of publication of this decree, the use of tar, oil, paints and all other substances that are insoluble or indelible to the washing by means of current industrial procedures is prohibited for the marking of:

(a) Livestocks, regardless of the place in which they are practised and the purpose pursued;

(b) Lanyards or wool and lanyards;

c) Bags, canvases, lighthouses or any other container or coverings used to store or transport wool or wool leathers.

Art. 2°- The use of any black paint or substance, whether or not indelible to the washing, for the purposes of marking the lanars, lanar leathers and containers for wool and leathers, as well as any external veterinary product containing in its tar composition, oil or any other black substance, is equally prohibited.

Art. 3°- The canvases and handbags marked before the date of this decree may be used until 31 December 1966, with black paint.

The Patagonian lighthouses marked with black paint can continue in use until the indicated date, provided they are coated with authorised paintings.

Art. 4°- The sale of paints to mark wools and wool containers, which have not been approved by the Lanas Directorate under the Directorate-General for Production and Livestock Development of the Ministry of Agriculture and Livestock.

To this end, any manufacturer or importer of the above-mentioned paints must request the Lanas Directorate to approve them, filling the following basic requirements:

(a) Indicate the name and address of the signature;

(b) Commercial name and components of the paint subject to approval;

(c) Delivery of a sample of such painting, for the necessary tests;

(d) Provide fifty (50) test marking lanars. This operation should be performed in a lanar breeding facility;

(e) The costs that demand the hiring of the evidence cited in the preceding paragraph, by a technician from the Lanas Bureau, shall be borne by the interested firm.

Art. 5°- To be approved, the paintings must meet the following conditions:

(a) The chemical composition of the painting must respond in full to the detail of the declared formula;

(b) When applied, the printed mark will be cleared;

(c) The mark, exposed to the environment, shall be kept legible, at least for a period not less than 12 months;

(d) When the wool is washed, by means of common industrial procedures, the paint must yield completely, without any trace.

Art. 6°- Paintings that meet the requirements of article 5, incs. (a), (b) and (d), shall be subject to the extension of a provisional approval certificate, which shall be granted within 20 days of the application and sample of the painting.

Final approval shall be agreed upon after the successful completion of the evidence provided for in article 4, inc. (d) and provided that it fills the aptitude provided for in article 5, inc. (c).

Art. 7°- The State Secretariat for Agriculture and Livestock, through the Bureau of Lanas, will periodically control the paintings on sale.

Art. 8°- The paintings already approved, pursuant to Ministerial Resolution 836 of May 1936, the former Ministry of Agriculture and Livestock, shall be valid for up to 90 days of the date of this decree, within which the new approval shall be required.

Art. 9°- For the purpose of the better implementation of this decree, the various divisions of the Ministry of Agriculture and Livestock, which have personnel in the ovine production zones, will collaborate with the Directorate of Lanas, in the manner determined by the Secretariat of State.

Art. 10- Any owner of ovines or a person or legal entity who for any reason is responsible for the care or transport of lanar animals, and farts, purses, armors and canvases containing sheep wools and leathers, is obliged to permit review of any person expressly authorized by the Ministry of Agriculture and Livestock.

Art. 11- Violation of the rules contained in articles 2 and 3 of Act No. 15,928, as well as non-compliance with the present decree, shall be punishable by fines of M$ 500 to 10,000.

Art. 12- The fines shall be imposed by the Secretary of State for Agriculture and Livestock, on the proposal of the Lanas Authority of its unit, prior administrative case, of which the accused shall be seen for the term of 10 days.

Art. 13- This decree will be endorsed by the Minister Secretary in the Department of Economics and signed by the secretaries of the State of Agriculture and Livestock and Trade.

Art. 14- Contact, publish, give to the General Directorate of the Official and Printed Bulletin and return to the State Secretariat of Agriculture and Livestock.
