ORGANICAL LAW.- Partially.

VISTO Issue No. 30.399/64 by which the Federal Police requests the amendment of Article 593 of the Rules of the Organic Law (Decree No. 6580/1958) and Article 146 of the Arms and Shooting Regulations (Decree No. 30501/1945 ), and

CONSIDERING:

That the modifications requested are aimed at establishing precise and specific rules in situations not provided for in the above-mentioned regulations, in safeguarding the higher interests of the collectivity and of the institution;

For this reason, and attentively, what is dictated by the General Directorate of Legal Affairs of the Ministry of the Interior.

Decrete:

Article 1- Add as article 593, paragraph 3, of the regulation of the Organic Law of the Federal Police (Decree No. 6580/1958), the following:

"Article 593...

(3) To request the authority that ordered the investigation of the proceedings when the circumstances make it advisable, the retention of the statutory armament of the accused, not to reintegrate it in case of kidnapping, or not to replace it with another, in case of being sent to a court. If it is considered convenient, it will be provided to the peticionado."

Art. 2°- Article 593, paragraph 3, which governs to the present, becomes paragraph 4 of the same article.

Art. 3°- Amend the number 146 of the Arms and Shooting Regulations of the Federal Police (R.R.P.F. 8, Decree 30501/1945), which shall read as follows:

"146.- The permanent use of the weapons provided by the institution is mandatory for all personnel, even if they are open or not uniform. However, when special security reasons so advise, the Police Chief may, at the request of the superior of the person who is dependent, order the retention of his or her regulatory weapon. The automatic guns are loaded, with cartridges in the chamber and low hammer. Service staff in offices are empowered to withdraw from their weapons by keeping them safe and out of the reach of the public, except at night guards. This authorization does not justify it in any case for diversion, subtraction or damage that may originate from the weapon."

Art. 4°- This decree will be endorsed by the Minister Secretary in the Department of the Interior.

Art. 5°- Contact, post, give to the General Directorate of the Official Gazette and Prints and archvese.
