War Secretariat ARMED FORCES DECEMBER 8,908 SANITY SERVICES.- Please clarify the scope of services provided by military doctors in compliance with their functions in provincial jurisdiction. Bs. As. 7/10/63.
VISTO is informed by the Secretary of State of War; proposed by the Minister Secretary in the Department of National Defence in case No. 1596/60 Cde. 3 (SG), and
CONSIDERING:
Among the powers of the Federal Government is to provide the organization and maintenance of the Armed Forces, as prescribed by article 67, paragraph 23 of the National Constitution;
It is essential for the proper functioning of these Armed Forces to have effective health services, the extent and modalities of which depend on the judgement of the National Government;
That such services normally involve the issuance of recipes and certificates of various kinds (vaccination, death, etc.), of external effects to the military sphere, and provided for by the Army by the Regulation of the Health Service in Guarnición (R. San E 1);
That the regulation also takes into account the possibility that the beneficiaries of the service may be prevented from meeting the places where the service is provided, or consequently, home assistance is authorized in such cases;
That the provisions of this type are reasonable in adequacy for the purposes of service and thus mean the legitimate use by the Nation of the power to organize and govern its Armed Forces, which the provinces cannot unlawfully hinder;
Therefore, the principle of federal supremacy is attentive, which is prescribed by article 110 of the National Constitution, and in accordance with the provisions of Mr. Procurator-General of the Nation,

Decrete:
Article 1.- They shall have full validity in the territory of the provinces, notwithstanding any provincial provision to the contrary, the recipes and certificates of any kind issued by military doctors in accordance with their functions, in accordance with the respective regulations.
Art. 2°- It may not be prevented by the provincial authorities, irrespective of the local precepts governing the matter, medical assistance provided by military doctors outside the garrisons, in cases provided for by the military regulations.
Art. 3. This decree will be endorsed by the Ministers Secretaries in the Departments of National Defence, Interior and Social Assistance and Public Health and signed by the Secretaries of State of War, Marina and Aeronautics.
Art. 4°- Communicate, publish, give to the General Directorate of the Official and Printed Bulletin, insert in the Public Bulletins of the State Secretariats of War, Marina and Aeronautics, withdraw from the Ministry of the Interior a copy of this decree to the Governments of Provinces, take note and return to the Secretariat of State of War (General Staff Directorate).
