EXTRAORDINARY LICENCES

They will be optional for officers who hold municipal elective positions.

VISTO the Regime for the Accumulation of Charges, Functions and/or Passivity for National Administration Staff, approved by Decree No. 8.566/61, and

CONSIDERING:

That article 3 of the same provides that staff within their scope, who are elected as a member of the executive or legislative branches of the Nation, the Provinces or the Municipalities, or appointed Minister, Secretary of State, Undersecretary or a member of the collegiate bodies of such jurisdictions, shall be removed from their functions, without possession, until the termination of their mandate;

That the municipal councillors and school councillors of the municipalities generally do not receive diets for their performance, but rather a compensation for roads, representation or transfer expenses, which in most cases is less than the remuneration of the permanent office they occupy in the National Administration;

That the performance of such charges has the character of public burden within the organic laws of most municipalities;

That in such conditions it would be appropriate to modify the mandatory nature of the removal of administrative functions for the staff concerned;

Therefore, and attentive to the proposal of the Ministry of State of Finance, in use of the powers resulting from Decree-Law No. 797/58 and article 20, paragraph 12, of Law No. 14.439,

The President of the Argentine Nation,

Decrete:

Article 1 - Determine that the unpaid leave prescribed by Article 3 of the Regulation of Characters, Functions and/or Passivity, approved by Decree No. 8.566/61, shall be optional for those agents who hold elective positions in the municipal order (Council or School Counselor), provided that there is no overlap of schedules with the position they hold in the National Administration.

Article 2 - The present decree shall be endorsed by the Minister Secretary in the Department of Economics and signed by the Secretary of State of Finance.

Art. 3° - Communicate, publish, give to the General Directorate of the Official Gazette and Prints and archvese.
