MINISTERY OF AGRICULTURA AND GANADERIA MANTIENSE MINISTERY FOR CONTRACTIONS OF APARCERIES AND AGRICULAR MEASURES FIGURED BY DECRETOS Nros. 30.013/49 AND 11.228/50 ON DISTRIBUTION OF DECRECT RULES No. 12,291

VISTO the authorization granted to the executive branch by article 55 of Act No. 13.246 to establish, after 31 May 1950, measures of a general nature and in the event of a disagreement of parties, the prices of leasing or percentages of distribution of fruits; the need to establish them for the 1950/51 campaign and the petitories formulated by representative entities of the interests of rural producers, both apparitions and tenants,

CONSIDERING:

That Decree No. 30,013 of 30 November 1949 provided for the economic situation of agricultural farms that were used to park on that date;

That Decree No. 11.228, of 5 June 1950, took into account the special nature of the contributions in the "measureries", where the aparceros dadores, in addition to concurring with the land, also participate with other exploitation expenses;

That the reasons set out in the decrees indicated remain;

That it is equally equitable razones for general reasons, not only of economic order, but mainly of climate origin; to keep for leases the price that corresponds to the date of Law No. 13.246, excluding the 20% reduction;

That the rules set forth in this decree are intended to regulate the situation of the parties involved in the crazy relations for the alleged disagreement between them, respecting, in strict observance of the aforementioned legal rule, what the contractors have agreed or agreed in the future, with the intervention of the agencies provided for in article 46 of the Act No. 13.246;

It is also desirable to consider those special situations of disagreement of parties, due to particular reasons of the case raised and therefore to escape the general considerations that motivate the present decree;

Therefore, the proposal of the Minister Secretary of State in the Department of Agriculture and Livestock,

The President of the Argentine Nation, Decreta: Article 1 . Mantiénense for the contracts of agricultural apparitions and medierias, on the percentages of the distribution of fruits of the crops corresponding to the 1950/51 campaign, the reductions established, respectively, in Decrees No. 30.013 of 30 November 1949 and No. 11.228 of 5 June 1950. Art. 2° . Stay for lease contracts until 31 May 1951, the corresponding price to be paid to the date of Law number 13.246, excluding the 20% reduction. Art. 3rd . The percentages of the distribution of fruits and leasing prices other than those resulting from the application of the previous article established in conciliations approved before the agencies created by article 4 of Law No. 13.246 shall be valid. Art. 4° . When special and particular reasons to the case arise, the case cannot be considered to be involved in the general situation provided for in article 2°, either party may submit it to the decision of the competent Regional Chamber, as provided for in article 55°, part 2 "in fine" of Law 13.246.
