Exception of the provisions of Decree 28.211-44

OF INDUSTRIA AND TRADE

DECEMBER 9.078. Bs. As., 13/4/49.

VISTO the Ministry of Industry and Trade of the Nation, number 61.108/46, and CONSIDERING:

That Decree No. 28,211/44 has taken into account the responsibility of the State, arising from acts or accidents in circumstances where the employees or agents of the Administration perform the functions entrusted to it;

That this provision deals primarily with administrative functions;

In addition to such tasks, the State undertakes, through its administrative bodies with managerial autonomy, other activities whose commercial or industrial nature is noticeable and whose exercise could be hindered by the application of the rules contained in that decree;

That Mr. Procurator of the Treasury has been issued holding that the exception to the rule established in the Decree No. 28,211/44 should facilitate a better development of the decentralized agencies of the State that should operate in accordance with commercial uses and practices;

For this reason and attentive to the proposal of the Ministry of Industry and Commerce of the Nation,

The President of the Argentine Nation, in General Agreement of Ministers,

Decrete:

Article 1 . Except for the provisions contained in Decree No. 28,211/44, to the decentralized agencies of the State operating commercial or industrial activities.

Art. 2o . Contact, publish, give to the General Directorate of the National Registry and archívese.
