ARTICLE 1 . Creation. Create a Bicameral Commission Researcher of alleged irregularities in the Juradas de Venta al Exterior (DJVE) Declarations of agricultural products. ARTICLE 2 . Object. The Commission created through the present will aim at the knowledge, investigation and clarification of alleged irregular manoeuvres related to advance presentations of Jury Statements of Sale to the Exterior (DJVE) of agricultural products without the accreditation of the possession and/or acquisition of such goods, which would result in significant fiscal damage. Article 3 . Integration. The Commission will be composed of SEIS (6) senators and SEIS (6) deputies, who will be appointed according to the rules of each House. ARTICLE 4 . Authorities. The members of the Committee shall elect UN (1) Chairman, UN (1) Vice-Chairman and UN (1) Registrar. They should also designate UN (1) Administrative Secretary. ARTICLE 5o . Period. The duration of the Commission shall be NOVATE (90) days, from the date of the constituent meeting. Such a period may be extended for one time for the same period by decision of the majority of its members. ARTICLE 6 . Meetings. The meetings of the Commission shall be held in accordance with the parameters set out in Article 98 of the Regulations of this H. Senate of the Nation. ARTICLE 7 . Faculty and powers. The powers and powers of the Commission established in article 1 of the present shall be as follows: (a) | Request all types of documentation and information, written or oral, related to the facts investigated, both in the public and private sector. |
(b) | Requiring and receiving testimonies from people. The witness will take oath or promise to speak truth, and before declaring it he will be aware of the penalties in the event that he asserts a falsehood or attenuates or silences the truth in everything or in part, unless the answer could self-incriminate him. |
(c) | Receive all sorts of evidentiary elements subject to their timely assessment. |
(d) | Require the exhibition of any kind of instrumental evidence reserved or secreted or not to public or private persons, and may review and kidnap trade books, financial instruments, computer records and any kind of documentation and correspondence that is relevant to the purposes of the investigation. |
(e) | To conduct inspections in public, semi-public and private places, by loosing the area in question. |
(f) | Demand the aid of the public force. |
(g) | To designate special advisers on tax and accounting issues, and may require collaboration with the Argentine Federation of Bar Associations and the Federation of Economic Science Professionals Council. They should submit a preliminary report to the Commission. |
The Commission shall require prior judicial authorization in the cases provided for in subparagraphs (d), (e) and (f) of this article. It may also request the intervention of the competent judge in any other case it deems appropriate.
ARTICLE 8 The Commission shall require the Presidency of both Chambers the budgetary allocation necessary for the achievement of the object set out in Article 2 of the present. Article 9 . Report. Before the end of the deadline set out in Article 5 of the present, the Commission shall submit to the Chambers a report containing its final considerations. ARTICLE 10.
