ARTICLE 1 . Object. Every older person has the right to access the realization of the practices called "falopio tube ligation" and "light of deferent or vasectomy channels" in the services of the health system. ARTICLE 2 . Requirements. The medical practices referred to in the previous article are authorized for any person who is capable and older than is formally required, being an inexcusable precondition to grant his or her informed consent.No consent of the spouse or convivor or judicial authorization is required except in the cases provided for in the following article.
Article 3 . Exception. When it comes to a person declared judicially incapable, the judicial authorization requested by the legal representative of that person is inescapable. ARTICLE 4 Consent informed. The intervening medical professional, individually or together with an interdisciplinary team, should inform the person requesting a tubing ligature or vasectomy about:(a) The nature and implications of the health of the practice to be carried out;
(b) Alternatives for use of other approved non-surgical contraceptives;
(c) The characteristics of the surgical procedure, its possibilities of reversal, its risks and consequences.
It should be noted in the medical history that it had provided such information, duly made up of the person concerned.
ARTICLE 5o . Coverage. Surgical contraception interventions under this Act must be carried out without charge for the applicant in the establishments of the public health system.Health officers covered by Act No. 23,660, social security organizations and prepaid medical institutions are required to incorporate these medical interventions into their coverage so that they are totally free for the beneficiary.
ARTICLE 6 . Objection of consciousness. Any person, whether a doctor or an auxiliary staff of the health system, has the right to exercise his or her conscientious objection without any consequence of work with respect to the medical practices set out in article 1 of this Act.The existence of conscientious objectors does not exempt from liability, with respect to the implementation of the required practices, the authorities of the appropriate care establishment, who are obliged to have the necessary replacements immediately.
ARTICLE 7 Amend to article 20, paragraph 18, of chapter I; of Title II of Law 17.132 of the legal regime of the exercise of medicine, dentistry and auxiliary activities thereof, which shall be drafted as follows:18: Practicing interventions that provoke the impossibility of breeding or conceiving without the informed consent of the patient capable and older or a judicial authorization when it were persons declared judicially incapable.
ARTICLE 8 , Add to section 6 (b) of Act No. 25,673 of the National Programme for Sexual Health and Responsible Procreation, the following text:In addition, the practices known as the ligature of fallopian tubes and ligature of deferential or vasectomy ducts are formally required as a method of family planning and/or contraception.
