NATIONAL ELECTORAL CODIGO Law 25.858 Modification. Sanctioned: December 4, 2003. Promulgated: December 29, 2003.

The Senate and Chamber of Deputies of the Argentine Nation assembled in Congress, etc. sanction with force of Law:

ARTICLE 1 Incorporate as the last paragraph of Article 94 of Law 19.945 of the National Electoral Code, the following:

Persons who have specific impossibility to make all or some of the movements themselves to bear, will be accompanied by the chairman of the table to the dark room, where alone with the elector, will collaborate with the necessary steps until the introduction of the vote, as the disability requires.

ARTICLE 2 It is incorporated as article 75 (d) of Law 19.945 of the National Electoral Code, the following:

(d) Voters over seventy (70) years who have been appointed as board authorities may be excused from such public burden, justifying only their age. The excuse will be formulated within three (3) days of notification. This subparagraph shall be printed on all designation telegrams.

ARTICLE 3 . Deflect subparagraphs (d), (h), (j) and (k) of Article 3 of Law 19.945 of the National Electoral Code. ARTICLE 4 Incorporate into Law 19.945, National Electoral Code, the following article:

Article 3° bis.- Proceedings who are serving pre-trial detention shall have the right to cast their vote in all acts of election held during the period of detention.

To that end, the National Electoral Chamber shall establish the Register of Private Electors of Liberty, which shall contain the data of the accused who are housed in such establishments in accordance with the information to be forwarded by the competent judges; it shall also establish voting tables in each of the detention facilities and appoint its authorities.

Proceedings who are in a different electoral district may vote in the establishment where they are hosted and their votes will be awarded to the District where they are registered.

ARTICLE 5° The rule of the preceding article shall enter into force on the basis of its regulation by the national executive branch, which shall be issued within the maximum period of twenty-four (24) months after the publication of the present article. ARTICLE 6 Contact the Executive.
