TELECOMMUNICATIONS Law 25.873 Amend Law No. 19.798, in relation to the responsibility of the lenders for the capture and referral of communications for their remote observation by the Judiciary or Public Prosecutor ' s Office. Sanctioned: December 17, 2003. Enacted: February 6, 2004.

The Senate and Chamber of Deputies of the Argentine Nation assembled in Congress, etc. sanction with force of Law:

ARTICLE 1 Incorporate article 45 bis to Law 19,798 with the following text:

"Every telecommunications service provider shall have the necessary human and technological resources for the capture and derivation of communications that they transmit, for their remote observation to the requirements of the Judiciary or the Public Prosecutor's Office in accordance with current legislation.

Telecommunications service providers must bear the costs of such an obligation and immediately comply with it at all times and every day of the year.

The national executive branch shall regulate the technical and security conditions to be met by telecommunications service providers regarding the capture and referral of communications for remote observation by the judiciary or the Public Prosecutor ' s Office. "

ARTICLE 2 Incorporate article 45 ter to Law 19,798 with the following text:

"Telecommunications service providers must register and systematize the filiatory and domiciliary data of their users and customers and the communications traffic records issued by them for consultation without charge by the Judiciary or the Public Prosecutor's Office in accordance with current legislation. The information referred to here shall be retained by telecommunications service providers for the period of ten years. "

Article 3 Incorporate article 45 quater to Law 19,798 with the following text:

"The national State assumes responsibility for any damages that may result to third parties, for the remote observation of communications and for the use of information on the filiatory and domicile data and for the trafficking of communications from clients and users, provided by telecommunications service providers. "
