TRANSITO AND VIAL SECURITY Law 25.965 Amend Act No. 24.449. Sanctioned: November 17 of 2004 Cast: December 20, 2004

The Senate and Chamber of Deputies of the Argentine Nation assembled in Congress, etc. sanction with force of Law:

ARTICLE 1 : Incorporate as article 5, paragraph 11 bis, Definitions of Law 24.449 as follows:

11 bis) Cycles: Distinguished road for the displacement of bicycles or similar non-motorized vehicle, physically separated from the other traffic lanes, through permanent buildings.

ARTICLE 2 : Incorporate as Section 9(f) Road Education of Law 24.449 the following:

(f) The transit authorities shall regularly carry out extensive campaigns reporting on the rules of movement in the public road, and the rights and obligations of drivers of all types and pedestrians.

ARTICLE 3 Incorporate as Article 21 bis Complementary Road Structure of Law No. 24.449 the following:

Article 21 bis: Complementary road structure. In the study prior to the construction of cycleways in existing road works or to be built, the demand for transit in the area of influence should be analysed in order to determine the necessity, reasonability of its execution, the capacity and density of the road.

ARTICLE 4 ) Incorporate as article 46 bis) Ciclovías de la Ley N° 24.449 el siguiente texto:

Article 46 bis: Ciclovías. The competent authorities will promote the planning and construction of a cycleway network or special routes for the circulation of bicycles and similar ones whose drivers will be required to use them.

ARTICLE 5° el Replace section 49(b) of Law No. 24.449 with the following:

3. On the path for pedestrians or bicycles, sidewalks, rails, on the road, and in the ten meters before and after the stop of the passenger transport.

No voluntary detention is allowed. However, it can be authorized, by means, to park on the external side of the sidewalk when its width is greater than 2.00 meters and the pedestrian traffic intensity allows it.

ARTICLE 6 Add to article 49 as subparagraph (d):

(d) The transit authority in its urban ordering provisions should include regulations that make it mandatory to delimit spaces for parking or storage of bicycles and similar in all establishments with great public participation.

They should also take the above forecasts in the garages, parks and beaches for the car park.

ARTICLE 7 . Incorporate article 40 bis) Requirements to circulate with bicycles to Law No. 24.449.

Article 40 bis) Cycling requirements. In order to circulate with a bicycle, it is essential that the vehicle have:

(a) A permanent and effective bearing, steering and brake system;

(b) mirror mirror mirror mirrors on both sides;

(c) Timbre, horn or similar;

(d) That the driver wears a protective helmet, does not wear loose clothing, and that it is preferably of light colors, and use footwear that is safely attached to the pedals;

(e) May the driver be your only occupant with the exception of the transport of a cargo, or of a child, located in a luggage rack or special seat whose weights do not jeopardize the maneuverability and stability of the vehicle;

(f) Lockers on both wheels;

(g) Lighting and reflective signalling.

ARTICLE 8 Invite the provincial governments and the Autonomous City of Buenos Aires to adhere to this law. ARTICLE 9 Contact the national executive branch.
