Corps of Attorneys and Lawyers for Victims of Gender Violence. Creation. Functions.

Law:

ARTICLE 1 — Trust the Lawyers and Lawyers for Victims of Gender Violence within the Ministry of Women, GÉNEROS and DIVERSIDAD, which will have as its mission to guarantee access to justice for persons victims of gender-based violence in line with the requirements of Act No. 26,485 on Comprehensive Protection for the Prevention, Punishment and Eradication of Violence against Women

ARTICLE 2 The functions of the Attorneys ' Corps for Victims of Gender Violence will be:

(a) To provide free legal sponsorship and comprehensive legal advice throughout the national territory to persons victims of gender-based violence in all their types and modalities set out in law 26,485 as well as gender identity or sexual orientation to ensure their access to justice in a timely and effective manner;

(b) Develop coordination and cooperation mechanisms with other agencies of the Executive, the Judiciary and the Public Prosecutor ' s Office, whether national, provincial or local, in order to provide an efficient response, both at administrative and judicial headquarters;

(c) To conclude agreements and coordinate actions with professional colleges, academic institutions and civil society organizations to provide specialized and free legal assistance;

(d) Conduct training, technical training, policy update and awareness-raising activities for the administration of justice and other actors involved in the comprehensive approach to gender-based violence;

(e) Disseminating legal sponsorship and comprehensive legal advice in the different jurisdictions, agencies, entities and units of the National Civil Service;

(f) Make recommendations and legislative proposals on gender-based violence;

(g) To promote the production and dissemination of reports and research related to the causes, nature, severity and consequences of gender-based violence, as well as to the effectiveness of measures taken to prevent and redress its effects, and the efficiency of the actions of agencies involved in their prevention, punishment and eradication;

(h) Promote the unification of criteria for the registration of information on gender-based violence and the development of statistics and the dissemination of statistics on a regular basis.

ARTICLE 3 — The Gender Violence Victims Lawyers and Attorneys Corps will be headed by an (1) Executive Director, who will have rank and rank as Assistant Secretary of State.

ARTICLE 4 The Executive Director of the Gender Violence Victims Lawyers and Attorneys Corps shall be appointed by the National Executive and shall meet the following requirements:

(a) To be an Argentine citizen and to have a lawyer ' s degree issued by a national university;

(b) Accredit five (5) years of enrolment;

(c) Accrediting experience and knowledge of gender-based violence and family law.

ARTICLE 5 — The Executive Director of the Lawyers and Lawyers for Victims of Gender Violence shall have the following duties and powers:

(a) To exercise the leadership of the staff of the Attorneys ' Corps for Victims of Gender Violence;

(b) Dictate and enforce the internal regulations of the Body;

(c) To promote the continued training of the Body members;

(d) To approve and coordinate the implementation of the annual operational plan;

(e) Establish rules and requirements for the admission of applications for legal sponsorship to constitute a criminal complaint of gender-based violence;

(f) To promote the institutional relations of the Body and to conclude agreements with public or private organizations, national or foreign, in order to achieve its objectives, either independently or in coordination with other competent bodies;

(g) To eliminate the proposed budget of the agency;

(h) Manage resources from the national budget and agency assets;

(i) Accept inheritance, legacies, donations and grants that assign to it public or private, national or foreign agencies;

(j) Promote and manage the collection of public and private, local and foreign resources and funds for the fulfilment of the Body ' s objectives;

(k) To proceed with the preparation and publication of the Annual Report of the Body.

ARTICLE 6 The Attorneys ' Corps for Victims of Gender Violence will have an Advisory Interdisciplinary Commission for the Comprehensive Approach to Gender Violence, which will be made up of professionals of at least university degree in the areas of law, social sciences and health that demonstrate expertise in gender issues as well as continuing work experience not less than five (5) years. The members of this Commission shall play their role in ad honorem. The functions of the Commission shall be:

(a) Assistant to the Executive Director of the Corps, as well as other law practitioners involved in gender-based violence as required, providing specialized technical advice to ensure comprehensive approach;

(b) Promote the unification of criteria and the systematization of relevant information among different agencies and organizations involved in the receipt of complaints of gender-based violence in order to avoid revictimization and the unnecessary judicialization of cases requiring other types of treatment;

(c) Propose recommendations for actions and remedies related to types and forms of gender-based violence that do not constitute a crime;

(d) Conduct risk reports in the context of gender-based violence cases, as necessary;

(e) Sensitizing body members and other actors involved in the comprehensive approach to gender-based violence.

ARTICLE 7 The members of the Attorneys ' Corps for Victims of Gender Violence shall review within the Specialized Group of the National Public Employment System in accordance with Decree 2.098 of 3 December 2008 and its amendments, as a specific orientation in the terms provided for in article 12.

Its entry shall proceed through the regime of contests of opposition and background under the modality provided for in article 52 of the said National System.

ARTICLE 8 — The members of the Corps may not exercise private advocacy in cases of gender-based violence.
