NATIONAL AGENDA FOR THE PREVENTION OF THE HLB ENVIRONMENT OF CITRUS

Chapter I

Object, scope and scope

ARTICLE 1 — The purpose of this law is to establish the National Program for the Prevention of HLB Disease (Huanglongbing or greening of citrus), whose insect vector is the Asian cytrus (Diaphorina citri).

ARTICLE 2 —
For the purposes of this law, call the bacterial agent of HLB (Candidatus liberobacter spp) as a “quarantine dish” in accordance with article 2 of Act 25,218 of accession to the International Phytosanitary Protection Convention.

ARTICLE 3o —
The fight against the so-called Asian Citrus Psilyd (Diaphorina citri) and other associated hemipters, contemplated in the regulations relating to the production, transport and marketing of citrus, is a public utility.

ARTICLE 4o —
The national prevention programme established by this law and the measures derived from it will be mandatory in all provinces where there is commercial production of citrus.

ARTICLE 5o —
The activities of the National HLB Prevention Programme will include:

1. Increased control and other prevention actions at border crossings, port terminals and airports.

2. Implementation of national and regional press and dissemination campaigns to provide the population in general and the citrus sector in particular with the necessary knowledge regarding the basic forecasts to be taken by the actors involved and to raise awareness of the potential seriousness of the problem.

3. Train staff from official and private institutions in field and laboratory disease detection and diagnosis systems.

4. Control the production and commercialization of plant species susceptible to HLB and Diaphorina citri vector (psyllide).

5. Require the use of nurseries under deck and the commercialization of certified citrus plants in accordance with the provisions of Resolution SAGPyA 149/98 and those others that replace or modify it.

ARTICLE 6o —
The presence of citrus plants with suspicious symptomatology of the disease, the denunciation will be carried out in a fervent manner by the owners, holders or holders of the predio, occupants, nurseries as well as any other responsible for those places where there are cyclical plants, both in the rural and urban sphere, to the National Monitoring and Monitoring System of Agricultural Plants created by SENA/02

ARTICLE 7o —
The findings of the suspicions or complaints must be made by the network of laboratories belonging to the SENASA, INTA, the "Obispo Colombres" (EEAOC) and universities.

ARTICLE 8o —
For the purpose of complementing the research and transfer projects developed in the present topic, the National Prevention Programme will process by 1 December of each year the data originating from the studies carried out in the relay activities carried out by both the disease and the vector insect, as follows:

(a) Detailed information on the areas in which phytosanitary measures related to the vector insect have been implemented and the results of its implementation, disaggregated by the type of measure applied, with an assessment of the effectiveness obtained in the control of the populations of the vector;

(b) Registration of authorized nurseries and traceability of plants.

Chapter II

Implementation authority

ARTICLE 9o —
The Ministry of Agriculture, Livestock and Fisheries of the Nation, through the National Food Health and Quality Service (SENASA), will be responsible for the implementation of this Act, which will regulate and implement the National Programme established in this Act.

ARTICLE 10. - To the SENASA, the coordination of an inter-institutional task force, made up of the National Directorate of Vegetal Protection, the National Institute of Agricultural Technology (INTA), the National Institute of Seeds (INASE), to the Agricultural Experimental Station "Obispo Colombres" (EEAOC) and other official research centers, universities, provincial governments, representatives of the private sector and provincial public

Chapter III

Coordination and financing

ARTICLE 11. - The overall coordination of the National Program for the Prevention of HLB Disease of Citrus will be carried out by SENASA. The National System of Monitoring and Monitoring of Plates (Sinavimo) will update the information derived from the activity detailed in Article 6 of this Law, which will be of public knowledge through the official portal of the coordinating agency.

ARTICLE 12. - The Ministry of Economy and Public Finance, within the limits established by the provisions available for these purposes, shall finance the preventive measures and the corresponding phytosanitary treatments for the reduction of pest populations in the amount of up to seventy percent (70%) of the expenses, based on the information provided by the implementing authority.

ARTICLE 13. - The amount of government funds provided for in the national budget for the implementation of the National Programme for the Prevention of HLB Disease of Citrus will be distributed according to the following guidelines:

(a) Distribution of recurrent citrus pest control costs in previous years;

(b) Data on early attacks of citrus pests in previous years, giving priority to action in those most vulnerable areas;

(c) The measures that the affected provinces foresee to take in the corresponding period and the expected situation that may influence the origin and progression of the pest.

Chapter IV

General provisions

ARTICLE 14. - The provisions of this Act shall have the status of basic rules under the relevant constitutional rules.

ARTICLE 15. - Expenditures for the implementation of the National Programme for the Prevention of HLB Disease of Citrus, prior to its regulation, shall be assigned to the National Treasury under article 75, paragraph 9, of the National Constitution.

ARTICLE 16. - Please provide the Ministry of Economy and Public Finance with the necessary provisions for the development of this law in the field of its competence.
