CONVENTION Law 27606 Adoption. The Senate and Chamber of Deputies of the Argentine Nation assembled in Congress, etc. sanction with force
Law:
Article 1- Approve the “Convenio de Transfer Progresiva a la Ciudad Autónoma de Buenos Aires de Facultades y Funciones de Seguridad en Todos las Materias No Federales Ejercidas en la Ciudad Autónoma de Buenos Aires”, held between the national state and the Government of the Autonomous City of Buenos Aires on January 5, 2016, whose text is accompanied as an Annex.
Article 2°- The annual expenditure that demands the transfer made to the Autonomous City of Buenos Aires in the framework of the agreement approved by Article 1 of the present and its quarterly updating mechanism will be agreed bilaterally by the national executive branch and the Government of the Autonomous City of Buenos Aires within a period of sixty (60) days that have been settled since the sanction of the present.
The Federal Tax Commission (CFI) will take action in the process according to the purpose of issuing a technical opinion for the determination of the annual weight of the components effectively transferred to the Autonomous City of Buenos Aires in 2016.
The General Budget of the National Administration of each fiscal year shall include the financing of the expenses set out in this article.
Article 3. Until the entry into force of the agreement provided for in Article 2 of the present, the twelve-fold weights of twenty-four thousand five hundred million ($24,500,000) will be transferred on a monthly and automatic basis from the National Treasury to the Autonomous City of Buenos Aires.
The amount foreseen in the preceding paragraph will be updated quarterly according to an index composed of eighty percent (80%) by the nominal rate of the average salary of the Argentine Federal Police and by twenty percent (20%), by the consumer price index (IPC) developed by the General Directorate of Statistics and Censuses of that Jurisdiction, both corresponding to the previous period.
Article 4°- From the entry into force of the present, the national executive branch shall transfer to the Autonomous City of Buenos Aires the corresponding participation in the application of article 8 of the law 23,548 and its amendments, as well as the sums for the attention of the expenditure required by the agreement approved by article 1 of the present, thereby meeting the requirement set out in article 75, paragraph 2, fifth paragraph, of the National Constitution.
Article 5°- The Chief of Cabinet of Ministers shall make appropriate budgetary adjustments for the purpose of the implementation of the present.
Article 6 This law shall enter into force from its publication in the Official Gazette of the Argentine Republic.
Article 7°- Please provide the Ministry of Economic Affairs with the necessary complementary and/or clarification to comply with this law.
Article 8°- Contact the national executive branch.
