LAW FOR THE IMPLEMENTATION OF COMPREHENSIVE ENVIRONMENTAL EDUCATION IN THE ARGENTINE REPUBLIC
Chapter I
Article
Article 1-This law aims to establish the right to integral environmental education as a national public policy in accordance with the provisions of Article 41 of the National Constitution and in accordance with the provisions of the article. 8º of the General Law of the Environment, 25,675; article 89 of the Law of National Education, 26.206; and other related laws such as the Law of Environmental Management of Water, 25.688; Law of Management of Residues, 25.916; Law of Forests Natives, 26.331; Glacier Law, 26,639; Fire Management Act, 26.815; and treaties and agreements International cooperation in this field.
Chapter II
Definitions
Article 2-For the purposes of this law, the following definitions are laid down:
Integral Environmental Education (EAI): is a permanent educational process with specific and transversal thematic content, which has as a general purpose the formation of an environmental awareness, to which they articulate and promote educational processes integral to the construction of a rationality, in which different knowledge, knowledge, values and practices converge and contribute to the formation of citizens and the exercise of the right to a healthy, dignified and diverse environment. It is a process that defends sustainability as a social project, development with social justice, the distribution of wealth, preservation of nature, gender equality, health protection, participatory democracy and respect for human rights. for cultural diversity. It seeks the balance between different dimensions such as social, ecological, political and economic, within the framework of an ethics that promotes a new way of inhabiting our common house.
National Strategy for Integral Environmental Education (ENEAI): is the instrument of strategic planning and the implementation of a permanent and concerted national public policy that reaches all formal and non-formal areas of the education, Information and Communication Technologies (ICT) and media. It is aimed at all ages, groups and social sectors, in order to territorialize environmental education through actions in the short, medium and long term.
National Strategy for Sustainability in Argentine Universities (ENSUA): it is part of the National Strategy for Integral Environmental Education (ENEAI) and aims to promote management in public and private universities throughout the country. national territory, for the purpose of which these institutions have the tools to decide to incorporate the environmental dimension in all the fields that make university life, from the curricular to the management of buildings, the extension and the research, with a view to the construction of a university environmental culture.
Comprehensive Environmental Education Strategy (EJEAI): the implementation and adaptation of the National Strategy for Integral Environmental Education (ENEAI) in the provincial and the Autonomous City of Buenos Aires through the corresponding articulation mechanisms for the institutionalization and implementation of programs, projects, actions and participatory spaces that promote the expression, vision and experience of the different actors and sectors (especially state, academic, educational and civil society), and that through its implementation generate lines of action in regional and local environmental policies, the promotion of institutional alliances, the deepening and consolidation of management processes in the medium and long term in the field of environmental education.
Executive Coordination of the National Strategy for Integral Environmental Education (CENEAI): it is the field of coordination, management and technical interministerial and federal administration oriented to the coordinated action of the jurisdictions for the effective concretion of the National Strategy for Integral Environmental Education (ENEAI).
Executive Coordination of the Judicial Strategy of Integral Environmental Education (CEJEAI): it is the area in which the articulation of the Judicial Strategy of Integral Environmental Education (EJEAI) is implemented and promoted in the field province and the Autonomous City of Buenos Aires.
Chapter III
Principles of comprehensive environmental education
Article 3-Environmental education, as a permanent, integral and transversal process, must be based on the following principles:
a) Interpretive and holistic approach: adopt the approach that allows understanding the interdependence of all the elements that make up and interact in the environment, in order to arrive at a critical and resolutive thinking in the management of themes and environmental problems, the sustainable use of environmental goods and services, the prevention of pollution and the comprehensive management of waste;
(b) Respect and value of biodiversity: it must be understood in the sense of countering the threat to the sustainability and durability of ecosystems and cultures that implies a close relationship with the quality of life of people and the communities whose importance is not only biological;
c) Principle of equity: must be characterized by promoting equality, respect, inclusion, justice, as constituting social relations and with nature;
d) Principle of equality from the gender perspective: inclusion in environmental and ecological analyses from the theoretical currents of ecofeminisms should be considered in its implementation;
e) Recognition of cultural diversity; the rescue and preservation of the cultures of indigenous peoples: environmental education must provide for democratic forms of participation in the various ways of relating to nature; valuing the different cultural models as an opportunity for growth in the understanding of the world;
f) Citizen participation and training: must promote the development of integral educational processes that guide the construction of an environmental perspective, in which the different knowledge, knowledge, values and practices converge in a regional and local awareness of environmental problems, and to promote citizen participation, communication and access to environmental information, promoting actions of a global nature, applied to the local situation;
(g) The care of natural and cultural heritage: it must include the assessment of cultural identities and the natural and cultural heritage in all its forms;
(h) Environmental problems and socio-historical processes: the approach of environmental problems should be considered as socio-historical processes that integrate economic, political, cultural, social, ecological, technological and ethics and their interrelations; the causes and consequences, the local and global implications and their conflict, so that they can be opportunities for teaching, learning and building new logics in the making;
i) Education in values: it must be based on an educational ethic that allows the person who promotes learning and who receives it, the construction of a thought based on values of care and justice;
(j) Critical and innovative thinking: it must promote the training of people capable of interpreting reality through approaches based on multidisciplinary, interdisciplinary, transdisciplinary and new techniques, models and methods for questioning existing models, generating possible alternatives;
k) Citizen exercise of the right to a healthy environment: it must be approached from a rights approach, promote the right to a healthy, balanced and suitable environment for the human and productive development of present and future generations, in relationship with life, communities and territories.
Chapter IV
National Strategy for Integral Environmental Education (ENEAI)
Article 4-Establish the National Strategy for Integral Environmental Education (ENEAI) as the main instrument of environmental education policy throughout the national territory.
Article 5-In the framework of this law are objectives of the implementation of the National Strategy for Integral Environmental Education (ENEAI):
a) Promote the development and development of the National Strategy for Integral Environmental Education (ENEAI) and the Judicial Strategies of Integral Environmental Education (EJEAIs); and its operational implementation, guaranteeing the creation and the existence of a specific programmatic area;
b) To determine, on the part of the educational authority, the modality of articulation of the integral environmental education component in the formal field, in order to comply with the National Strategy for Integral Environmental Education (ENEAI) and the Jurisdictional Strategies of Integral Environmental Education (EJEAIs);
c) To develop at national level and with the participation of the jurisdictions a study of environmental perception on the different target audiences that allows to establish a baseline oriented to adjust the National Strategy of Environmental Education Integral (ENEAI) and the corresponding Judicial Strategies of Integral Environmental Education (EJEAIs) to the reality of the territories in reference to the needs and demands of its implementation;
d) Strengthen the technical capabilities for the implementation of the strategy, through the professionalization of the human resources involved in all jurisdictions, through the training and improvement of graduate and postgraduate;
e) Develop and design national policies and guide jurisdictional policies, strategies, and comprehensive environmental education actions, in accordance with the approaches prescribed in Chapters I, II and III of this Law;
f) To achieve the widest territorial, social and sectoral coverage at national level and to promote the jurisdictional strategies of integral environmental education (EJEAs), together with mechanisms of social consultation and interinstitutional management, ensuring systematicity, coherence, continuity and sustainability of the ongoing management of environmental education;
g) To generate basic and fundamental social consensus on which to establish thematic agreements and strategic and short-term priorities, referring to the contents of national comprehensive environmental education and its federalization;
h) Create a repository of comprehensive environmental education experiences accessible by computer procedures via the Internet;
i) Generate and manage mechanisms that facilitate the systematic implementation of the 2030 Agenda with its Sustainable Development Goals (SDGs), and/or those that will be agreed in the future;
(j) Promote consensus that ensures long-term sustainability for the prevention and control of processes likely to produce predatory and irreversible environmental impacts;
k) To promote programs of integral environmental education in the training of agents of national, provincial and municipal public administration and technical assistance to the government sectors that so require, for the development of their programmes and projects in the framework of the National Strategy for Comprehensive Environmental Education (ENEAI);
(l) Develop, publish and distribute official and free Environmental Education materials on all available and appropriate media in accordance with the principles laid down in this Law.
Article 6-Intergenerational environmental commitment. Establish that the World Environment Day is to be held every year and, in order to strengthen the commitment to the environment throughout society, each jurisdiction must promote a community action in which the "Commitment" is encouraged. Intergenerational Environment " in which, in different areas of society, children, young people, older adults, government officials and officials, attending to the effective participation of indigenous peoples, have the opportunity to establish a pact of responsibility with the environment and successive generations. Each jurisdiction will have the modality of implementation in the educational agenda of at least one day or space of institutional improvement dedicated to environmental education and will give due diffusion on the activity, its participants, as well as the giving of the corresponding entries for the participation.
Implementing authority, powers and powers
Article 7-The National Strategy for Integral Environmental Education (ENEAI) is a shared responsibility, with differentiated competences and faculties, between the Ministry of Environment and Sustainable Development and the Ministry of Education, as The law of the General Environment Law, 25,675; in the Law of National Education, 26.206; in conjunction with the Federal Council of the Environment (COFEMA) and the Federal Council of Education (CFE).
Article 8-The Ministry of Environment and Sustainable Development of the Nation, the provincial jurisdictions, the Autonomous City of Buenos Aires and the Federal Environment Council (COFEMA) will have the power to implement the National Strategy of Integral Environmental Education (ENEAI) and the Judicial Strategies of Integral Environmental Education (EJEAIs) in the field of non-formal education, Information and Communication Technologies (ICT) and media, as established in the Article 103 of Law 26.206.
Article 9º-The Ministry of Education of the Nation, of the provincial jurisdictions and of the Autonomous City of Buenos Aires, in conjunction with the Federal Council of Education (CFE), will have the power to implement the National Strategy of Integral Environmental Education (ENEAI) and the Judicial Strategies of Integral Environmental Education (EJEAIs), in the fields of formal, non-formal education, Information and Communication Technologies (ICT) and media.
Chapter V
From the Executive Coordination of the National Strategy for Integral Environmental Education (CENEAI) and the Advisory Council
Article 10.-The National Strategy for Integral Environmental Education (ENEAI) will be made operational through the inter-ministerial, interjurisdictional and permanent intersectoral joint, through the Executive Coordination of the National Strategy of Integral Environmental Education (CENEAI), assisted by a Consultative Council composed of civil society organizations.
Article 11.-Create the Executive Coordination of the National Strategy for Integral Environmental Education (CENEAI). Such coordination shall be responsible for making the requirements of Article 5 of this Law effective, by means of the following actions: the consultation of guidelines, themes, priorities and resources which, as prescribed in this law, will serve the compliance with the National Comprehensive Environmental Education Strategy (ENEAI). The design of plans and programs of reach in the different jurisdictions, through the different means available. The development of an integrated system of lines of action, objectives, indicators and goals with reach in the different jurisdictions, that guide and allow to monitor and evaluate the implementation of policies and activities throughout the territory national.
Article 12.-The Executive Coordination of the National Strategy for Integral Environmental Education (CENEAI) will be shared and coordinated on the basis of its competencies and will be composed of representatives of the Ministry of Environment and Development. Sustainable de la Nación, Ministry of Education of the Nation, Federal Environment Council (COFEMA) and Federal Council of Education (CFE). Each body shall have two (2) holders and two (2) alternates, appointed or formally appointed. In its conformation, it will be necessary to attend to the gender parity. The Presidency of this Coordination will be held in a rotating manner by representatives of the Ministry of Environment and Sustainable Development of the Nation and the Ministry of Education of the Nation with a hierarchy not less than Director or National Director.
Article 13.-The provinces and the Autonomous City of Buenos Aires are recommended to create in their jurisdictions the Executive Coordination of the Judicial Strategy of Integral Environmental Education (CEJEAI) as a management, coordination and implementation of the Comprehensive Environmental Education Strategy (EJEAI).
Article 14.-Create the Advisory Council of the National Strategy for Integral Environmental Education (CENEAI), whose role will be to assist and advise the enforcement authorities in the implementation of the National Education Strategy. Integral Environmental (ENEAI). In the formation of the organism, the gender parity must be met.
Article 15.-Invite to participate in the Advisory Council to representatives of the following entities: organizations of the second degree representative of indigenous peoples; educational organizations of public, private and technical education with national recognition; representatives of the student and youth sector; representatives of the national scientific sector and the various jurisdictions; representatives of national universities; representatives of private universities; representatives of public sector rangers (national and provincial); representatives of private sector rangers; representatives of recycling and recycling organisations; and representatives of civil society organisations with proven interest in environmental education. The convening of the participants of the Consultative Council will be defined within the Executive Coordination of the National Strategy for Integral Environmental Education (CENEAI), with the participation of its members.
Representatives of the Committee on Natural Resources and Conservation of the Human Environment of the Chamber of Deputies of the Nation, representatives of the Education and Culture Committee, and representatives of the Committee of Education, Representatives of the Environment and Sustainable Development Committee of the Senate of the Nation.
Article 16. The Advisory Council may be convened ad hoc by the Executive Coordination of the National Strategy for Integral Environmental Education (CENEAI) in a virtual or in-person manner. It will express its opinions in writing and its minutes will be signed by the member institutions and will be communicated to the aforementioned Executive Coordination as a contribution to the National Strategy for Integral Environmental Education (ENEAI).
Article 17. The representativeness of the members of the Advisory Council will address the previous consensuses that have emerged in their respective sectors.
Article 18.-The members of the Executive Coordination of the National Strategy for Integral Environmental Education (CENEAI) and its Advisory Council will carry out their ad honorem posts or as part of their ministerial, legislative and legislative powers. Article 19.-The Executive Coordination of the National Strategy for Integral Environmental Education (CENEAI) will be formally convened and its resolutions will be taken by consensus among its members. Article 20.-The Executive Coordination of the National Strategy for Integral Environmental Education (CENEAI) will have the task of generating the appropriate mechanisms to make the provisions of articles 3 and 5 through the appropriate bodies and regularly review the National Strategy for Comprehensive Environmental Education (ENEAI), taking into account at least and specifically:
a) Ensure the administration, management and implementation of the National Strategy for Comprehensive Environmental Education (ENEAI) in all fields of application;
b) The effective incorporation and transversal management of environmental education at all levels and modalities of the national education system;
(c) the formulation of national environmental education programmes in the field of initial and continuing teacher education at all levels and modalities of the national education system;
d) The elaboration of theoretical and methodological guidelines on environmental education to incorporate scientific, technological, technical, social sciences and citizen training;
e) The training and technical assistance of the public administration agents of the different jurisdictions;
f) The elaboration and publication of official and free environmental education materials;
g) The identification of the needs and interests of the community and priorities of the country and its regions in the thematic area;
h) The promotion of the strengthening of the actions of civil society organizations that include environmental education among their objectives, seeking their articulation with the National Strategy of Integral Environmental Education (ENEAI);
(i) The impetus for the implementation of comprehensive public communication and environmental education campaigns;
j) The broad and regular dissemination of information and knowledge that the process of the National Strategy for Integral Environmental Education (ENEAI) generates in the different bodies involved;
k) The generation of an annual report on the progress of the National Strategy for Integral Environmental Education (ENEAI) to present to the Legislative Branch and the citizenry, as provided for in Article 18 of the General Law of the Environment, 25,675;
l) The production of awareness campaigns and audiovisual content to be disseminated by the public or private media system.
Operation
Article 21.-The Executive Coordination of the National Strategy for Integral Environmental Education (CENEAI) shall be convened within a period of no more than ninety (90) days from the entry into force of this Law and shall carry out a review and update of the the National Strategy for Integral Environmental Education (ENEAI) that reflects the consensus reached and establishes the operational framework for its implementation.
Article 22.-The essential elements for the development of the baseline of community environmental perception and representation of national scope and with the participation of the jurisdictions will be defined, and will discuss the modality of development of the same by forming a guiding document for the implementation of the National Strategy for Integral Environmental Education (ENEAI).
Article 23.-The resulting consensus document and the derivatives produced by the Executive Coordination of the National Strategy for Integral Environmental Education (CENEAI) will be complemented by the Environmental Education Strategies. Integral (EJEAIs) in order to establish the updated document of the National Strategy for Integral Environmental Education (ENEAI) as a National Policy of Integral Environmental Education.
Chapter VI
Right to information
Article 24.-The implementing authority shall ensure in all policies, agreements and actions arising from this law the respect of the rights established in the legal framework established by law 25,831, Free Access Regime Environmental Public Information, and the Regional Agreement on Access to Information, Public Participation and Access to Justice in Environmental Matters in Latin America and the Caribbean (Escazú), approved by law 27.566.
Chapter VII
Curricular content
Article 25.-Incorporation. In accordance with Article 92 (g) of the National Education Act, Article 92 (g) shall be read as follows:
g) The awareness of the importance of the environment, biodiversity and natural resources, their respect, conservation, preservation and prevention of damage, in accordance with Article 41 of the National Constitution, Law 25,675 and International agreements on the environment and international conventions.
Additional provisions
Article 26.-Financing. The expenditure resulting from the application of this law shall be allocated annually to a specific item allocated for such purposes in the General Budget Law of the National Administration.
Article 27.-Commune to the national executive branch.
