Law on modification of the code approved by the Hon. General Council in the traditional sign of Sant Andreu of the day December 4, 1991 preamble the significant and continuous activity regulations of the EU and its Member States and, in particular, of the neighbouring countries in the area of regulation of the circulation of vehicles and transport In addition to the growing needs of integral management of road traffic in Andorra, certainly justifies the exercise of legislative initiative of the Government to submit to the approval of the General Council an act of partial modification of the traffic Code in force.

With this modification is intended to achieve two fundamental objectives: on the one hand, and continue the complex and irreversible process of legal approximation of Andorra to the Community legislation in all the economic, social and administrative matters necessary for progress and institutional development of the valleys;

on the other hand, the adequacy of the traffic rules in the Community guidelines on regulation of road traffic, the technical inspection of vehicles, the ecology and the environment. At the same time, and as it is necessary to rectify and improve the system of exposure, it is to adapt the way regulations, the data or quantitative references of some of the precepts of the code that have been affected directly by the other objectives of this partial reform.

In this sense, the partial reform law modifies the criteria for priority in intersections of rotating circulation (article 10), the number of cases of prohibition of stops and parking lots (article 32), empowers the Government to modify regulatory rules enforced for temporary signage and obstacles in public (article 28) and emphasizes especially the renewed regulation of driving and circulation of vehicles intended for the transport of hazardous or flammable (article 70). A more rigorous regulation of compulsory helmets and approved by the competent Public Administration, respect for drivers and users of motorcycles, has also been the subject of a specific regulation and more developed (article 72). On the other hand, modifies completely the article 73 concerning vehicles intended for specifically the transport of workers, which will significantly improve the conditions in which it has to carry out this type of transport.

The new article 76 have been modified the limitations of weight in the different types of vehicles. 77 article regulates systematic criteria with a more accurate the maximum width and height of the vehicles. In the same way, article 78 adapts the length of vehicles to the standards in force in the legal system of the EU.

In articles 101, 102, 103 and 104 new traffic signals have been introduced internationally adopted and which were not foreseen in the previous articles.

In the article 111 has been modified a reference to a previous article, but it has preserved the totality of the writing.

Has been renewed to the wording of article 112, but remains in substance the antecedent, it gives a clearer administrative discipline in the delivery of national driving permits Andorran to foreigners. Follows the same criteria in the regulations of articles 113, 114, 115, 116 and 117 in which modify the categories of driving permit and specify the various categories of vehicles that you authorize. Modifies the 118 article dedicated to the regulation of the rules of procedure for the obtaining of the driving permit and the rights and stakeholder review. Likewise, in article 119 modifies the term of validity of the various categories of driving licence.

It gives too much importance to the powers attributed to agents of the authority in all cases in which its intervention is necessary to protect the order of the road traffic and the safety of people and property. For this reason, article 124 dedicates new sections to the regulation of the most frequent cases in which vehicles are affected by a decision motivated by these agents.

The modification of article 127 responds to the desire to make the maximum effort to reduce the effect of alcohol in road crashes. To this end, modifies the maximum allowable rate of alcohol in the blood of drivers of passenger transport and goods.

Due to the modification of the categories of driving licence, modify articles 129, 131 and 132 concerning the first two medical exams for obtaining the driving licence and the latest in theoretical and practical tests to obtain the same permission.

In articles 141 and 142 establishes a specific regulation of the registration of imported second-hand vehicles and administrative controls in order to ensure the legal security and road traffic.

In the article 143 modify various issues relating to the certificate of registration.

The modification of article 145 implies more technically suitable regulation of the transmissions of vehicles already registered.

In articles 153 and 155 is given a complete regulation of the temporary registration of vehicles, and in article 159, the conversion of foreign tourist in temporary registrations registrations of Andorra. It is, in these precepts, to solve some practical problems posed in Andorra in relation to this type of registration.

The reform takes a considerable scope to articles 162 and 164 in relation to the rules on transformation, construction and repair of vehicles and severely injured on vehicles. This reform was much needed, as the old legal code left many of the practical problems without express legal solution.

The same rigorous criteria appear in articles 166


and 167 in which are fixed the basic rules of administrative activity of technical inspection of vehicles. Also in this case, a regulatory policy complements the imperatives of law to ensure the technical controls required for all vehicles registered in Andorra.

Articles 168 and 169 summarized the General features of the technical conditions of vehicles and the obligation of compliance. In articles 184 and 185 modify several questions related to the characteristics of the trailers.

Articles 196 and 198 regulate respectively the allowable limits of noise and smoke by vehicles cars and adapt to the rules in force in the legal system of the EU.

Chapter VIII, new creation, must serve until the General Council enacted a law regulating the transport of goods, to regulate transport cards, delivery and other appropriate administrative rules.

Also new are the chapters IX and x. the first regulates an issue extremely important, as is the circulation of the special vehicles, goods and passengers, and empowers the Government to apply the necessary measures for their regulation. The latter regulates an aspect not foreseen in the previous articles, as is the movement of bicycles and similar vehicles.

Finally, modify various aspects of the annex No. 1. 1, dedicated to the registration of special vehicles.

Accordingly, the General Council has approved the law of partial reform of the code of the circulation.
