In all these years, the Andorran School has developed and continues to develop their educational task with responsibility and quality in order to ensure the intellectual training and civic and social, human growth of the students. For the proper development of the educational and social work, education professionals across national boundaries, the Andorran School also has non-teaching staff involved in the surveillance of the areas of patios and dining rooms.

However, since 1989, the legal system has evolved, and the approval of the law on the public function, of 15 December 2000, has limited the recruitment of staff is not official, although that is essential for the monitoring of patios and dining rooms.

This staff, used a few hours a day, its mission is to serve the students in the school canteen and carry out leisure activities and recreation that are developed on the patio midday. The little time available daily dedication to the noon does not allow to create places of civil servants, in accordance with the said legislation. In the same way, the restrictions have been approved for the recruitment of agents of the administration of temporary nature do not allow to extend in time the contracts of these people. Faced with this situation, the Government was entrusted with the indirect management of the recruitment of the staff of patios and dining rooms to a single company, solution that has not led to the quality or stability of employment expected.

In order to ensure the stability, the security of the work and the best quality of staff of patios and dining rooms that work for a long time in the Andorran School, the Government wants to proceed with the modification of the law of the Andorran School.

The school, already existing in each centre of the Andorran School is made up of representatives from all sectors of the education community: director and head of studies at the centre, a member of the common, representatives of the teaching staff, educational, administrative and personnel assistant personnel services, parents, and students of the educational levels of secondary and high school , and has as its main object to ensure the proper functioning of the centre.

The mission and the composition of the Board of school make it the most appropriate body to take on the recruitment of the personnel mentioned.

This administrative body, chaired by the director of the centre, is lacking in the legal regulation is necessary in order to engage directly the staff of patios and dining rooms, in the labour scheme.

The present Law adds a new title in the Andorran School Law in force, which should allow the Board of each centre being able to hire the staff necessary for the surveillance of patios and dining rooms, thus guaranteeing a higher quality and stability of this staff, without the Government intervening, since in the future will have legal capacity and capacity to act.

Article XVIII The School Board is chaired by the director of the centre. The nineteenth article of the functions of the Board are: a school) to hire the staff of surveillance of patios and dining rooms, in the labour scheme of provision of services.

b) Collaborate with the management team on the budget of the centre.

c) to ensure the application of the educational project of the Center.

d) to ensure the application of the regulation of internal regime of centre, resolve conflicts and impose corresponding sanctions relating to discipline of students, in accordance with the regulations mentioned. Once in force, the regulations on rights and duties of pupils, the resolutions of the Board of school must hold to it.

e) collaborate in the preparation of the annual plan of the centre.

f) to evaluate the annual plan of the centre and the report submitted by the Board of Directors, which should include a balance of economic management.

g) give the go-ahead and provide suggestions to the programming and development of school activities carried out outside the centre, during the school hours.

h) establish the criteria for the participation of the centre in cultural activities, sports and recreational purposes.

and to ensure the conservation and refurbishment proposed) of the installations and of the school team.

j) supervise the general activity of the centre.

Article twenty-The recruitment of staff in the labour regime of the provision of services necessary to carry out the monitoring of patios and living rooms, on the part of the School Board, may be made by any of the following methods: a) Contracting Party directly to the staff of patios and dining rooms.

b) Through the adjudication of the recruitment of auxiliary staff of patios and dining rooms to a company in the sector.

Article twenty-first the necessary financing to ensure the recruitment of the staff of patios and dining rooms for part of each School Board, is awarded by the Ministry in charge of education, through its budget.

Article twenty-second operation and the procedure of election of the School Board establishes the regulations. "

Final provision this law shall enter into force the day after its publication.
