Law 23/2008 of 30 October, the licensing of the University of the Valley since the General Council in its session of October 30, 2008, has approved the following: law 23/2008 of 30 October, the creation of the University's licensing of the preamble in article 20.2 of the Constitution recognizes the freedom of education and grants to individuals and companies the freedom to create educational centres within the respect for constitutional principles.

Given that the Ministry in charge of higher education, has verified compliance with the requirements established by the regulations in force relating to the creation of private universities, this law is in line with the stipulated in article 68 of the law 12/2008, of higher education, June 12, 2008, and the University of the Valley, defines the framework in which this develops and creates the degrees offered It determines the guidelines for the initiation and maintenance of academic activities, as well as the provisions to take into account in case of any conflict in order that students can complete the studies initiated in accordance with the General rules for the termination of the plans of study. To this end, the law foresees the need to present agreements with other universities or, in default, a bank guarantee.

The law also regulates the requirements of access and stay of students, the monitoring and evaluation of the teaching and the revocation or the variations in the conditions of the creation.

Article 1 Establishment 1. Authorises the creation of the University of the Valley, as a private University, that must be established by adopting the legal form of a private foundation of public interest.

2. The University of the Valley is governed by law 12/2008, of June 12, of higher education, by law 11/2008, of June 12, of foundations, and by the rules of organisation and operation approved by the University within the framework of its autonomy.

3. In accordance with the provisions of article 4 of the law 12/2008, of June 12, of higher education, the rules of organization and operation of the University must be in conformity to constitutional principles and must respect fully the freedom of Chair, which is manifested in the freedom of teaching, research and study. The University has been to organize in such a way that it is guaranteed the effective applicability of these principles and these freedoms, using the appropriate participation of the University community.

4. The rules of organization and operation of the University of the Valley, as well as their amendments have to be endorsed by the Government.

Article 2 centers, studies, recognition of degrees and study periods validation 1. The University of the Valley consists initially of a single University centre specialising in dental science, which should be responsible for the organisation of the courses that you are and of the academic, administrative and corresponding management processes.

4. The recognition of periods of studies corresponds to the University, in accordance with the criteria previously set by regulation.

Article 3 Home and maintenance of academic activities 1. The Ministry responsible for higher education authorized the commencement of academic activities, after having checked that have been met both the requirements of the legislation and the commitments by the sponsoring entity in the report accompanying the request for the authorization of creation of the University.

2. The University of the valleys should work for the minimum period required for the students to complete their studies in accordance with the General rules for the termination of the plans of study.

For effecting this requirement, the Government requires the presentation of agreements with other universities in which students enrolled in the University of the Valley could continue their studies, in extreme case.

In the absence of these agreements, the Government requires a bank guarantee, updated anyalment based on the number of students enrolled, and that for the first year, in the amount of € 10,000 base multiplied by the number of registrations. This initial amount will increase annually in line with the CPI.

Article 4 access and permanence of students 1. For access to the University of the Valley must meet the requirements established by the legislation for access to university education.

2. The University of the valleys should establish the criteria for admission and permanence of students to their schools and must ensure that, both in the regulation and in the application of the criteria mentioned, will recognize the rights of access and permanence, without any discrimination, in accordance with the principles of equality, merit and ability.

3. To make effective the right of access, the University of the valleys should make public information relating to the offer of courses and the system of grants for the study.

Article 5 monitoring and evaluation 1. In accordance with the current regulations, the external evaluation of the University of the Valley and its centres dependent on the Government or of the delegated body for this.

2. In addition, the Government is responsible for the supervision of the University of the Valley.

3. The University of the Valley must collaborate in the tasks of monitoring and supervision of the Government, which has to provide the necessary documentation and access to the facilities that, for these purposes, may be required.

4. the University must submit annually to the Ministry competent in the area of higher education, a report with the teaching and research activities that have been carried out.

Article 6 Revocation and variations in the conditions of the creation


1. The Ministry responsible for higher education must confirm the validity of the change of name of the educational centres.

If after this period has not been given the requirement, with prior hearing of the rector, the Ministry responsible for higher education should propose to the Government, with provisional, partial or total shutdown of activities for a period that may not exceed 30 days, coming forced the Government, in addition to communicate immediately and so within such a decision to the General Council and to present , asking for urgent procedure, the relevant legislative initiative to the effect of the possible revocation of the University.

If the severity of the breach requires it, the Government can agree on the loss of recognition of a State title.

In any case, the Government should require the University to guarantee that students registered to the end, with a normal academic performance, studies started.

First transitional provision the University of the Valley consists initially of a single centre of university education specifically dedicated to studies of Dental Sciences. As a result, the public name of the College is: Faculty of Dental Sciences of the valleys.

Likewise, the University of the Valley you can use publicly the name of University when the institution has at least one other Center of university education that includes another category distinct from the Dental Sciences.

Second transitional provision the authorization of the creation of the University of the Valley expires, if you are not requesting the authorization for the start of activities referred to in article 3, within a period of two years from the day after the entry into force of this law.

Final provision this law shall enter into force the day after being published in the official bulletin of the Principality of Andorra.
