Law 27/2010, of 3 June, from extraordinary credit to cope with the costs of urgent intervention at the Hotel Rosaleda, declared of cultural interest in the category of monument since the General Council in its session of June 3rd, 2010 has approved the following: Law 27/2010, of 3 June, from extraordinary credit to cope with the costs of urgent intervention at the Hotel Rosaleda , declared of cultural interest in the category of monument preamble the Department of Cultural Heritage has as a priority the protection of assets of cultural interest and is their responsibility to undertake actions that, directly or indirectly, affect the conservation and protection of the cultural heritage of Andorra. In this context of guardianship, the conservation of the Hotel Rosaleda becomes urgent, and is therefore a priority for the Department. This well protected suffers a deterioration that is compounded over time. It is necessary to make the study of pathologies of the building to define the detailed intervention project that should serve to carry out the consolidation of this monument.

The Hotel Rosaleda was declared an asset of cultural interest in the category of monument on 11 February 2004 under law 9/2003, of 12 June 2003, the cultural heritage of Andorra. The Hotel Rosaleda is the work of the renowned architect of the noucentista movement Adolf Florensa. Built between 1941 and 1943, represents one of the most emblematic buildings of the architecture of granite, and is part of the numbered examples during the second third of the 20th century were designed by prestigious architects in Andorra, incorporating in the country the current foreign and cosmopolitan expressive gestures.

Its conservation status has serious problems because of a series of incidents that endanger the integrity. The draft budget for the financial year 2010 foresaw a provision to deal with the costs of urgent intervention at the Hotel Rosaleda to sanitation and the replacement of the structure (change the pillars, the walls and a stretch of floor), the clearing of the rubble (Dinger of the false ceilings, roof), the tapament of all the openings and the refurbishment of the roof.

When the General Council does not approve the general budget Law, as in the case of this year, the Executive can not cope with the costs of capital, with the exception of the transfers in the Commons, that the head of Government, with the prior agreement of the Government, can make effective in accordance with the general law of public finance.

In this case, the general law on public finance determines the extension of current spending budget of the preceding financial year and the effect of the credits approved by multi-annual character, in addition to the authorization to the Executive to make effective transfers in the Commons.

As a result, the Government does not have credits to cope with the costs of urgent intervention at the Hotel Rosaleda, which are encrypted in 1,004,000 euros.

Seen that the character of urgency and necessity of the expenditure on investment concept is justified by the fact that the State of conservation of the Hotel Rosaleda presents serious problems due to a series of incidents that endanger the integrity and that it is an asset of cultural interest in the category of monument declared by the Government;

Seen the report of the General intervention;

Seen the agreement of the Government of 24 March 2010.

Article 1 approves an extraordinary credit for an amount of 1.004.000 euros for the following budgetary items: Cultural Heritage Department, 560-561 Property and ethnological heritage protection Area-60910 studies and projects of investment-2010-Hotel Rosaleda 0000000001, for a total of 4,000 euros;

Cultural Heritage Department, 560-561 Property and ethnological heritage protection Area-61210 Improvement of buildings of architectural interest-2010-Hotel Rosaleda 0000000001, for a total of 1,000,000 euros.

Article 2 This extraordinary credit is financed through a new debt.

Final provision this law enters into force on the same day to be published in the official bulletin of the Principality of Andorra.
