Preamble the draft budget for the financial year 2010 foresaw an endowment to finance current expenses and capital of the Andorran Health Care Service.

In the exercise of the powers which it has assigned to the SAAS in the law of creation of the Andorran Health Care Service, of 23 December 1986, it is essential to carry out a series of investments to deal with the technical obsolescence of facilities and spaces, to new therapeutic claims, to new techniques and technologies, and that it can carry out the deployment of information systems that started in previous years in order to provide maximum security for the facility. and in the current space.

On the other hand, the SAAS must have the funding required to finance the costs of staff and of consumption of goods and services for projects, which should not be postponed until the following year due to its usefulness for the population, as well as the services of maintenance of equipment and facilities purchased in previous exercises in which, once the warranty period starts, in this exercise, the maintenance contracts. However, the credits available in dozens parts are not enough to cope with the expenditure mentioned.

When the General Council does not approve the general budget Law, as in the case of this year, the Executive cannot deal with capital transfers, with the exception of the transfers in the Commons that the head of Government, with the prior agreement of the Government, be made effective in the Commons, in accordance with the general law of public finance. In this case, the general law on public finance determines the extension of current spending budget of the preceding financial year and the effect of the credits approved by multi-annual character, in addition to the authorization to the Executive to make effective transfers in the Commons.

As a result, the Government does not have the total number of credits or has insufficient way to deal with these costs, which rise to 6,336,581 euros.

Seen that the character of urgency and necessity of these expenses is justified by the fact that it is necessary to ensure continuity in the functioning of capital expenses and currents of the Andorran Health Care Service, especially with regard to the maintenance of new equipment and new health care projects, in accordance with current legislation and with the law of creation of the Andorran Health Care Service;

Seen the report of the General intervention;

Seen the governmental agreement of 21 April 2010;

Article 1 approves an extraordinary credit for an amount of 4,768,420 euros (1,750,050 euros for the financial year 2010 and 3,018,370 euros in multi-annual character for 2011), for the next budget starting: 620 621-resources Organization Department Service Area-the Andorran health care Service 76111-PROJ-0059 SAAS Investment.

Article 2 approves an additional credit for an amount of 1.568.161 euros, for the next budget starting: 620 621-resources Organization Department Service Area-41111 SAAS-PROJ-0101 HNSM operating Grant.

Article 3 The extraordinary credit for 2010, for an amount of 1.750.050 euros and credit fee, for an amount of 1.568.161 euros, are financed by the budgetary Department 210 and 211-Heritage spending and financial operations-public debt Interest 30000-PROJ-0009-Public Debt, for a total of 3,318,211 euros.

The credits of expenditure with pluriannual, as well as their financing, an amount of 3,018,370 euros, respectively, will be included in the 2011 budget when it is developed, in accordance with article 29 of the general law on public finance.

Final provision this law enters into force on the same day to be published in the official bulletin of the Principality of Andorra.
