lo26037003 law 8/2014, 29 may, to amend the law 3/2014, of 23 January, of the budget for the financial year of 2014 as the General Council at its session of 29 may 2014 has approved the following: law 8/2014, 29 may, to amend the law 3/2014, 23 January , the budget for the financial year of 2014 preamble In the 30 April 2014, the Government, at the proposal of the Minister of health and welfare and of the Minister of Justice and the Interior, approved the reorganization of the medical transport by land, which will allow an integration of the Department of prevention and fire extinguishing and rescue in the provision of medical transport services by land. The aim of this reorganization is to optimize and rationalize the human resources and public materials available and, therefore, significantly reduce the deficit generated by the provision of these services and to adjust the budgetary transfers to ensure the funding, while maintaining the quality of services and without involving a negative impact for users.
So, once it completed the reorganization approved, the fire brigade will take over the whole of the internal services health transport not scheduled primary, with the exception of the services that require a medicated support. These services, whether internal or external, will continue to be assumed by means of own resources of the Andorran Health Care Service, while the external services internal services side not scheduled not medicalised and is carried out by means of an external outsourcing of the necessary resources for this purpose. This outsourcing will be effective with the previous bid of a national public competition in order to be awarded the purchase of these services to a company (or a temporary Union of companies) established legally in Andorra and that have the resources and means needed to carry out this type of medical transport services.
From the 30th of November 2007 and the master plan of the medical transport that approved and develop the Andorran Health Care Service, the internal services health transport not scheduled primary and secondary, as well as external services, in all cases not medicalised, have been rendered much mostly by two private companies, which was awarded the performance of these services. Indeed, the successful bidder in the public tender launched in April 2007 to outsource the services mentioned above were these two companies, with which the Andorran Health Care Service signed a contract, which ended on 30 November 2013, despite having signed a new one for a duration of six months, in order to implement the reorganization recently approved.
However, the fire brigade has not been never completely separated from the provision of internal services health transport not scheduled primary, since the year 2007 has continued bringing them out in certain geographical areas of Andorra, is continuously, it is only during the nighttime slots. On the other hand, it should be noted that since it was created in 1961, and up to the year 2007, one of the main missions of the fire brigade has been to make sure the medical transport services.
The reorganization, which has been approved recently will mean that the fire brigade to provide about 4,500 annual services health transport, instead of almost 400 services that made the year 2012, while the company or joint venture companies in which pre-empt the national public competition will provide approximately 1,000 annual medical transportation services, instead of the more than 5,000 services that the two private companies carried out in 2012. On the other hand, it has been estimated that the overall cost of the medical transport by land, that the year 2012 amounted to 2,260,124 euros, will be reduced to 1,247,877, which represents an annual saving of 1.012.247 euros.
This calculation of costs takes into account the spending that will lead to the hiring of five new fire troops, not only with regard to the salary that they have to register, but also with regard to their equipment and training, as well as the expenditure arising from the acquisition of two units of conventional ambulance vehicles. The creation of these five new fire jobs it is essential to be able to materialize with all necessary guarantees, in accordance with the objectives that have been pointed out, the integration much more important of the Special Department for the prevention and extinction of fire and rescue services in the provision of medical transport services that has decided to spread them. Therefore, this contract is an indispensable premise for the implementation and the development of the necessary reorganization approved, in order to achieve the purposes of optimization, rationalization and global savings that flow. On the other hand, in accordance with these goals, the creation of new jobs listed, once we have carried out appropriate modifications within the fire brigade regarding shifts in the effective allocation and schedule in the barracks, should make it possible to give to the permanent realization of overtime with a structural character that, for many years , has distorted the purpose of these hours, as defined in articles 7 and 8 of the Decree of 31 December 2003, for approval of the regulation of compensation systems that lack of a law and a specific regulation on this matter, it is applicable to the fire brigade.
For this reason, bearing in mind that paragraph 1 of article 24 of the law 3/2014, of 23 January, of the budget for the financial year of 2014 expected during the year 2014 cannot create new places of civil servants or agents of the administration of indefinite, it is necessary to promote a modification of this section, for the purpose of making possible the creation of five new seats as a civil servant for the fire brigade or Department and fire prevention and rescue.
Article only modifies the paragraph 1 of article 24 of the law 3/2014, of 23 January, of the budget for the financial year of 2014, which is worded as follows: "Article 24 recruitment of staff 1. During the year 2014 cannot create new places of civil servants or agents of the administration of indefinite, with the exception of five new seats as a civil servant for the fire brigade or Department and fire prevention and rescue.

Final provision this law comes into force the day after being published in the official bulletin of the Principality of Andorra.
