By contract dated October 1, 1990 the Government formalized a new rental contract of the same terrain, which was renovated and complement the contract of 1978. Prior to the formalization of this lease, this area was used as farmland.
Such contracts of the 1978 and 1990 stipulate that at the end of the lease period, the Government has the obligation to demolish all the buildings and facilities provided by the Government in the land leased, and restore it to the previous state, that is to say, the topographic relief and agricultural utility I had in the year 1978 (cover of topsoil).
The Government earmarked the land, from the outset, a sports area, mainly for the practice of soccer; and, with this object, built the works suitable for this purpose, they consist basically in a soccer field of regulatory measures, with the corresponding seats and complementary facilities (dressing rooms, toilets, showers, warehouses, etc.); another sports area, smaller and more versatile; a parking lot; a building destined to residence Concierge facilities; a building used as a café and auxiliary facilities, and services necessary for the whole of the equipment (electrical transformer, House of access control, perimeter walls, etc.). All these constructions and facilities continue to be found in the reference in the present day, although, with the exception of the parking lot, are obsolete.
The term of the lease ended, without a contractual option to extensions left unspoken, on 31 December 2004. From that date the Government and ownership have kept negotiations aimed at establishing a new rental contract, for the whole or part of the premises. In spite of the time spent in the negotiations, the agreement was not possible.
Thus, since the rental period has expired and that the renewal is not possible, in compliance with the terms of the rental agreements signed on the December 1, 1978 and October 1, 1990 the Government has the obligation to demolish all the buildings and the facilities provided by the Government in the land leased, and restore it to the previous state , that is to say, the topographic relief and agricultural utility I had in 1978 (cover of topsoil).
In the same vein, to date 7 July 2016 judicial transaction, the Government is committed to demolish all the buildings and facilities that are part of the sports complex of Aixovall, and to restore the land leased to the previous agricultural State on 28 February 2017.
In particular, by virtue of the commitments acquired by the related rental contracts, the Government should tear down the following works: the bleachers of the football field, all the buildings and the facilities associated with the football field (changing rooms, warehouses, referees room, toilets, showers, etc.), the football field itself (artificial grass, concrete base, etc.), the complementary sports field (artificial grass , concrete base), the building assigned to the residence of the Concierge, the building meant to bar and auxiliary premises, other additional buildings (control booth at the entrance of the enclosure, transformer, etc.), the perimeter fences of the land, and the walls of sustaining, levelling and separation. The Government has to make the movement of land necessary to restore the same topographic relief that corresponded to the year 1978, and spread a layer of topsoil on the entire surface.
It has been estimated in 700,000 euros the cost of spending needed to comply with the commitments acquired by the signed rental contracts, as described in the dates 1 December 1978 and October 1, 1990.
Even though the lease contract won in 2004, and since then the Government and ownership have kept negotiations aimed to renew the lease. These negotiations have been lengthened to entered the year 2016. It was not until the beginning of the year 2016 that it has been confirmed by the two bands that is not possible to reach a point of balance between the interests of each one. As a result, the Government has to run immediately are the work of demolition of the sports field of Aixovall and restitution of the land in the previous state.
Given that the situation described was not clear up into the current year, and that for this reason there is no budgetary allocation in the Budget to cover spending for 2016 jobs that the Government has an obligation to run as soon as possible;
Given that it is urgent to have a budgetary allocation in the Budget to cover the whole cost corresponding to the works of demolition of the sports field of Aixovall and restitution of the land in the previous state;
Seen that the Government does not have the credits necessary to deal with these expenses, encrypted in 700,000 €;
Given that the need and the urgency to carry out the demolition of the sports field of Aixovall and the return of the land to the previous state for an amount of € 700,000 are justified by the importance of fulfilling contractual commitments acquired by lease contracts signed in 1 December 1978 and October 1, 1990, and in compliance with the legal transaction of the 7 July 2016 that States that the Government will have to complete these works as a no later than the 28th of February 2017;

Seen that the Government, by agreement of 12 October 2016, has approved an advance of funds for a total amount of € 700,000, intended to finance the works of demolition of the sports field of Aixovall and restitution of the land in the former State, for the following game: 700 Department of Territorial-708 support Cabinet, landscape and image-22790 other jobs abroad-1998-0000000013 school Infrastructure sports, and others;
Seen the report of the General intervention;
Seen the agreement of the Government of 12 October 2016;
Article 1 approves an extraordinary credit of an amount of € 700,000 for the game following budget: 700 Department of Territorial-708 support Cabinet, landscape and image-22790 other jobs abroad-1998-0000000013 school, sports and other Infrastructure.
Article 2 This extraordinary credit funded by the two budgetary items as well: 700 Department of Territorial Ordinance-public works Department 704-60910 studies and projects of investment-2004-Deflection 0000000003 Sant Julià de Lòria by an amount of 625,000 euros.
700 Department of Territorial Ordinance-Public Building area 705-60910 studies and projects of investment-2015-0000000007 former residence Building Solà d'enclar for 75,000 euros.
Final provision this law comes into force the day after being published in the official bulletin of the Principality of Andorra.
